P~68-33 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM TNAT PETITION FOR VARIANCE NO. 1943 BE DENIED WHEREAS, the City Planning Commission oE the City of Anaheim did receive a verified Petition for Veriance from S.I.R. DEVELOPMENT ~MPANY, INCORPORATED, 1314 South Brookhurst Street, Anaheim, California 92804, Owner of certain real property situated in the City of Anaheim, County of Orange, State of CaliFornia, described in Exhibit "A" attached hereto and referred to herein as though se~ forth in full ; and - WHEREAS, the Ci[y Planning Commission did hold a public hearing at the City Hell in the City of Anaheim on Januery 29~ 196~~ at 2:00 o'clock P.M., notice of said public hearing having been duly given as required by law andin accordance withthe provisions of the Anaheim Municipal Code, Chapter 18,68, to hear and consider evidence for - and egainst said proposed variance and to investigete end make findings and recommendetions in connection therewith; and WHEREAS, said Commission, aftez due inspection, investigation, and study made by itself and in its behelf, and after due consideration of all evidence and reports offered at seid hearing, does find end detennine the following facts: 1. That ihe petitioner requests a variance from the Anaheim Municipal Code, as follows~ in order to establish existing real estate signs and banners as a conforming use, and to oermit additional similar signs. SEC??0^! 1R.62.~,0(A) - Ivumber and size of off-site sians. (A maximum of 3 tract signs oermitted; 23 signs proposed) SECTIOV 1f3.62.070(B) - Location of off-site sions. (Off-site signs to be located no closer than 20 feet from any highway right-of-way line, or closer than 25 ftat from intersection of street-curb lines; petitioner proposes to erect signs within the parkway area of the public right-of-way.) ' SECTION 18.62.030(c) - Definitions - Which defines a free-standing sign as a sign which does not project over highway rights-of-way or future highway rights-of-way as set .`orth on the Circulation Element of the General Plan; subject signs are existing and are pro- posed in the oarkway. SEGTION lti.b?.130 - Which permits the displ.ay of flags and banners for advertising purp~ses in the C-1, C-2, C-3 and C-0, and C-R Zones only; subject oroperty is zoned R-1. 2. That there are no exceptional or extraordinary circumstances or conditions applicatlc to the oroperty involved or to the intended use of the property that do not aop~.y~generally to the property or class of use in the same vicinity and zone. 3, Tha~ the requested variance is not necessary for the preservation and enjoyment of a substantial property right possessed by other oroperty in the same vicinity and zone, and denied to the property in rn~estion. 4. That requests for encroachment into th•, ~ublic i;; `.-of-way can be granted only by the City Council• however, t he proposed waivers rec,,,,steo woula ~ contrary to all rec~ulations of the Sign Ordinance and, therefore, should be denied bec.:use of the excessive signing in the public riqht-of-way. 5. That the petitioner is requesting more t`~ `~00;6 increase in the number of signs over that permitted by the Sign Ordinance, and approva sub'ect desirable precedent for similar requests when nevr aivision developmentslaresconstructedun- throuqhout the City. 6. That the petitioner is requesting more than 800% increase in the number of signs over that permitted by the Sign Ordinance, and approval of subject petition would establish an un- desirable precedent for similar requests when new subdivision developments are constructed throughout the City. 6.
