PC68-34 A RESOLUTION OF THE CITY PLANNIIVG COM~NISSION OF THE CITY OF ANANEIM RE~MMENDING TO THE CITY Q~UNCIL OF THE CITY OF ANAHEIM TO EXECUTE A WRITTEN CONSENT TO THE AMENDMEPf!' TO DEED RESTRICTIONS HERETOFORE IMPOSED ON THE FOLLOWING DESCNIBED PROPERTY AT THE REQUEST OF SAID CITY OF ANAHEIM WHEREAS~ the City Council in Ordinance No. 1422, dated November 24, 1959, established C-1, General Commercial Zoning, deed restricted to medical and dentzl offices, professional offices, pharmacies, flower shops, coffee shops, and rest homes on property described as follows: - That portion of Section 9, I'ownship 4 South, Range 10 West, S.B.B, 8 hi. Commencing at a point 50 feet South of the North line of said section, therefore 50 feet South of the centerline of La Palma, 405.69 feet west of the centerline o: La Palma at the junction of ~7est Street as shown on the map of a section of said section made for F. W, Fleischmann, and filed in Book 1, Page 56 of Record of Surveys in the office of the County Recorder of Orange County, California. Proceeding Southward 674.8 feet to the North line of the County Flaod Control Right-of-Way, as recorded in the Oranae County Flood Control Right-of-Way Carbon Creek Channel - B-1, Map 10; thence 631.4 feet Northeast along the North line of said Flood Control Right-oF-Nlay, ending at a point _ 33 feet from the midline of West Street; thence North 224.2 feet to the point 50 feet South of the centerline of La Palma Avenue; thence parallel to the centerline of La Palma Avenue Westward for a distance of 383.1 feet to the point o: begi.nning; and WHEREAS, Anaheim Men;orial Hospital requested clariiication of Ordinance No. 1422 to determine whether the Hilihaven Convalescent H~soital property is approved for hosoital use; and WHEREAS, the City Attorney's Office determined that the language of the aforementioned ordinance is specific in that it permits a"rest home" and that it could not be construed that a hospital is presently an approved use for subject property and, therefore, recommended to the Planning Commission that a public hearing be hel4 ~o cons'der any amendmeni to or deletion of these deed resi:ricti~ns; and 1 ~ WHEREAS, the City Plan.iing Commission did hold a public hearing at the City Hall in th2 ~. City of anaheim on January 29, 1968, at 2:00 0'clock P.M., notice of said public hearing having _ been duly given as required by law and in accordance with the provisions of the Anaheim Niunicipal - Code, Chapter 18,72, to hear and consider evidence for and against said proposed amendment to deed restrictions and to investigate and make findings and recommendations in connection ther r with; and WHEREAS, saicl Commission, after due inspection, investigation, and study made by itself and in its behalf, and after due consideration of all evidence and reoorts ofiered at said hearing, does find and determine the following facts: 1. That the "Criteria for Admission" data submitted by Anaheir, Nemorial Hospital indicates •that the use proposed at the Hillhaven Convalescent Hospital would be comparable to the use that was originally approved on sUbject proo erty, and is presently being conducted at that facility. 2. That Conditional Use Permit No. 998 was considered and approved by ±he Planning Cummission to permit the Hillhaven Convalescent Flospital as a hospital annex ior ambulatory patients requiring minimal care. '; 3.
