TRAPf~, ET AL, 5219 ~hady Gien Lane, Anaheim, California 92806, Owner; JACK SPENC~ER DAVIS,~ 6700 Stanton Avenue, Buena Park, California 90620, Ag ent of certain real property situated in the City of Anaheim, County of Orange, State of California, described as That portion of the East half of the northeast quarter of the southeast quarter of section 12, Township 4, South, Range 10 West, in the Rancho San Juan Cajon de Santa Ana, as per map recorded in book 51 page 10 of Miscellaneous Maps, in the office of the county recorder of said county, lying northerly of the north line of the land described in the deed to the State of California, recorded November 26, 1963 in book 6817 page 876 Official Records. EXCEPT that portion thereof described in the deed to Humble Oil and Refining Company recorded January 28, 1964 in book 6899 page 798 of Official Records. ALSO EXCEPT the East 30.00 f ee't of that portion thereof included within the s~utheast quarter of said northeast quarter of the southeast quarter. ~ ; and ~' ,,~ WHER EAS the City Planning Commission did hold a public hearing at the City Hell in the City of Anaheim on November 189 t968~ et 2:00 o'clock P.M., notice of said public hearing having been duly given as required by law and in eccordance with the provisions of the Anaheim Municipal Code, Chepter 18.68, to hear and consider evidence for and against said proposed variance and to investigate end make finding's and recommendations in connection therewith; ` end ~~ 'i ~ \ ,.~ WHEREAS, seid Commission, after due inspection, investigation, and study made by itself and in its behalf, and efter due consideration of all evidence and repods offered at seid hearing, does find and determine the following fects: 1. That the petitioner requests a varience from the Anaheim Municipal Code as followsY to develop subject property with a 286-unit apartment complex: S~ECTION 18 3.050 3 - Maximum lot coveraae. (Twelve separate variances from this Code provision proposed). SECTION 18e28.050(9-b) - Location of livina units from a standard street. (A maximum of 200 feet permitted; 250 feet proposed)o 2. That because the property is adequate in size and no hardship had been proven, waiver of the maximum lot coverage for the southerly portion is hereby denied. 3. That the requested variance, as approved, is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone, and denied to.the property in question. 4. That this variance is granted subject to the completion of Reclassification No. 68-69-43. 2. That subject property shall be dev~loped substantially in accordance with plans and specif ications on file with the City of Anaheim, marked Exhibit Nos. 1, 2, 3, and 4, provided that the plans for the southerly por•tion shall conform to the maximum lot coverage provisions of the R-3, Zone.
