WHEREAS, the City Planning Commission of the City of Aneheim did receive a vedfied Petition for Varience ~ from FREDRICKS DEVELOPMENT CORPORATION, 524 West Commonwealth, Fuilei•ton, California 92632, Owner of certain real property situated in the City of Anaheim, County of Orange, State of California, described as the West 11 acres of the southWhalf of the south-half of the southwest ~,,, ` quarter of Section 1, in Township 4 South, Range 10 West, in the Rancho San Juan Cajon de Santa '`'~' r Ana, as shown on a map thereof recorded in book 51, page 10, Misceilaneous Maps, records of "s' ~ -~ said Orange County. EXCEPTING THEREFROM the Southerly 200 feet of the Westerly 200 feet <~; '~~ thereof ~ , ` F ~ : i~ i ~ 'I~ ; end WHEREAS, the City Planning Cornmission did hold a public hearing at the C3ty Hall in the City of Anaheim onDecember 16. 1968, at 2:00 o'clock P.M., notice of said public hearing heving been duly given es required by law and in accordence with the provisions of the Anaheim Municipal Code, Chapter 18.68, to hear and consider evidence Eor end against said proposed variance and to inveskigete and make findings and recommendations in connec- tion therewith; and WHEREAS, said Commissinn, after due inspection, investigation, end study mede by itself and in its behelf, and after due consideration of ell evidenae and reports offered at seid hearing, does find end determine the Eollowing facts: : Thaf the petitioner requests a variance from the Aneheim Municipal Code as follows, to permit the establishment of a retail tire, battery, and auto accessory store on subject property~ SEGTIODI 18040~020 -• Permitted uses. (The proposed use requires C~2 or C-3 Zoning; C_1 Zoning exists and is proposed). 2. Thet there are exceptional or extraordinary circumstences or conditions eppliceble to the property in•~olved or to the intended use of the property that do not epply generally to the property or class of use in the seme vicinity and zone. 3, That the requested variance is necessary for the preservation and enjoyment of a substantiel property right possessed by other property in tha same vicinity and zone, end denied to the ptoperty in question. 4. That the requested veriance will not be materially detrimental to the public welfete or injurious to the pmp- erty or improvements in such vicinity and zone in which the property is loceted. 5. Tnat due to the nature and the intensity or" the proposed operation and its relation- ship to the shopping center, and the enclosed nature of the other commercial facilities in this center, it is the opinion of the Commission that all service bays should face the east, in order to retain the l~armonious aesthetics and reduce possible pedestrian and vehicular conflicts adjacent to the entran::e and exit of the center. That trash storage areas shall be provided in accordance with app~oved plar,s on file with the office of the Director of Public Works. 2. That any air-conditioning.'facilities proposed shall be properly shielded from view, ~ and the sound shall be buffered from adjacent residential homes. 3, That parking areas shall be lighted with down-lighting a maximum 6-feet in height ~' and shall be directzd away from the property lines to protect the residential integrity of the area. 4. That Condition Nos. 1, 2, and 3, above mentioned, shall be compiied with prior to ~ final building and zoning inspections. , ~' 5.
