WHEREAS, the City Planning Commission of the City of Anaheim did receive a verified Pe[ition for Variance f:om
FRANK MULLER, % CLIFF WOLFE, WAGNER AND ASSOCIATES, 606 South Oiive Street, Los Angel~s,
California 90014, Owner; TIMOTHY E. WEIL, 2550 5th Avenue, Suite 629, San Diego, California 92103
Agent of certain real oroperty situated in the City o` Anaheim, County o.` Orange, S{ate of
Califo:nia, describeo in Exhibit "A" attached hereto and referred to herein as though set forth
in .`ull

WHEREAS, the City Planning Commission did hold e public hearing at the City Hell in the City of Anaheim on
February 14 1968~ ~ at 2~00 o'clock P,M., notice of seid public hearing heving been duly given as required by
lew end in accor~ance with L.e provisions of the Anaheim Municipal Code, Chapter 18.68, to hear and consider evidence for
and against said proposed variance and to investigete and make findings and recommendetions in connection therewith;
and
tVHEREAS, said Commission, after due inspection, investigation, end study made by itself nnd in its behelf,
and nfter due consideration of all evidence and reports otfered at said hearing, does find end detertnine the following
facts:
1. That the petitioner requests e variance from the Anaheim Municipel Code, as `011ows, to install a
:ree-standing sign on subject property.
SECTIO[J 18.62.090(B-2) - Heiaht of free-standinq sians (25 feet permitted; 60 feet
nronosed.)
- Area of free-standina sians (350 square `eet permitted;
~304 square feet proposed.
2. That there are no exceptional or extraordinary circumstances or conditions applicable
to the property involved or to the intended use of the property that do not aoply generally to
the property or class of use in the same vicinity and zone.
3. That the requested variance is not necessary ior the preservation and enjoyment o` a
substantial property right possessed by other prooerty in the same vicinity and zone, and
denied to the property in question.
4. That the reouested variance will be materially detrimental to the public welfare or
injurious to the property or improvements in st~ch vicinity and zone in which the prooerty is
located, since it will create a visual intrusion into the residential development to the south.
5. That the petitioner has not proven a hardship would exist, since the sign could be
erected within a landscaped area.
6. That several commercial facilities have been developed recently on prooerty immediately
to the east of subject property and all signing that has been established on these parcels
conforms to the height and area requirements of the zone.
7. That since subject oroperty has 800 feet of frontage along Lincoln Avenue, be:tween
Crescent Way and Muller Street, signing in con:ormance with sian regulations should pr~vide
adequate identification of the proposed facility.
