P~68~~0 A RESOLUTION OF THC CITY PLANNING COMh1ISSION OF THE CITY OF ANAHEIM THAT PETITION FOR VARIANCE NO. 1950 BE GRANTED ' WHEREAS, the City Planning Commission of the City of Anaheim did receive a verified Petition foz Veriance from THEODORE 0. BIRKHEIhiER, 1717 West Lincoln Avenue, Anaheim, California 92801, Agent of certain reai propPrty situated in the City of Anaheim, County of Orange, State of Cali:ornia, described as Lot Tlvo of Tract No. 658, as per mao recordFd in Book 20, oage 36, Iviiscellaneous Naps, R~cords of Orange ,~ County ; and IVHEr2EAS, the City Plenning Commission did hold a public heerins at the City Hatl in the City of Anaheim ; on February 26~ 1968~ at 2:00 o'clock P.hf., r.otice of said public heering having been duly given as required ~ by law and in accordance with the provisions of the Anaheim Municipal Code, Chapter 18.68,to hearand consider evidence Eor and egainst said proposed variance and to investigate and make findings and recommendations in connec- tion therewith; and IVHEREAS, said Commissi~n, after due inspection, investigation, and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: 1. That the pe[itioner reauests a variance From the Anaheim Municipal Code to permit the expansion of exist.° ing war2house facilities: SFCTION ]Ft 16 ~~n - Permitted uses in the R-A, Zone (Proposed use is not permitted in the R-A Zone). 2. That there are exceptional or extraordinazy circumstances or conditions epplicable to the property involved or to the intended use of the property that do not apply generelly to the property or cless of use in the same vicinity ' and zone. 3. That the requested variance is necessary for the preservation and enjoyment of a substantial pzopeRy right possessed by other property in the seme vicinity and zone, and denied to the property in question. 4. That the requested variance will not be meterially detrimenta] to the public welEare or injurious to the prop- erty or improvements in such vicinity and zone in which the property is (ocated. 5. That the..petitioner oroooses to corstruct a 2000 scjuare f oot warehouse addition to the rear of the existing building wherein a non-conforming use is in operation. 6. That the existing use was established v~hile under the jurisdiction of the County, how- ! ever, upon annexation into the City of Anaheim, zoning was reverted back to the R-A Zone. ~' 7. That there are several other non•-con.orming uses in this area, and the existing use of ~ subject property is not detrimental to these uses; however, if the property was placed in the aporopriate zone, then the existing use would demand a full range of the lioht industrial uses ' which would be permitted, and some of the uses might be incomnatibie with other uses in the area. ~ NOW, THEREFORE, BE IT RESOLVED that the qnaheim City Plenning Commission d~oes hereby grant subject Petition for Variance, upon the following conditions which ete hereby found to be a necessary p~erequisite to the pro- posed use of the subject property in order to preserve the safety and general welfere ofthe Citizens of the City of Anaheim: 1. That street i~r,~rovement plans shall be prepared and all engineering requirements of the City of Anaheim along Lincoln Avenue, such as curbs and gutters, sidewalks, street grading and i paving, drainage facilities, or other appurtenant work shall be completed as required by the City Engineer and in accordance with standard plans and specifications on file in the office of the City Engineer; and that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installation of said engineering raquirements. 2..That the ov,mer of subject property shall pay to the City o: Anaheim the sum of $2.00 per front foot along Lincoln Av?nue, for street lighting purposes. , 3. That the owner of subject property shall pay to the City of Anaheim the sum of 15¢ oer frant foot along Li.ncoln Avenue, for tree planting purposes. ''~•~~ 4.
