PC 68-72A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE rrTy OF ANAHEIM THAT PETITION FOR VARIANCE NO. 1957 BE DENIED NHEREAS, the City Planning Commission of the City of Anaheim did receive a verified Petition for Variance from ATLANTIC RICHFIELD OOAIPANY, 1786 West Lincoln Avenue, Anaheim, Cali:ornia 92801, Owner; FEDERAL SIGN AND SIGNAL CORPORATION, 1100 North Main Street, Los Angeles, California 90012, Agent of certain real property situated in the City of Anaheim, County of Ora;:;e, State of California, described as Lot Nos. 1 and 2, Block A of Tract No. 158 WHEREAS, the City Planning Commission did hold a public hearing at the City Hell in the City of Anaheim on March 25~ 1968~ at 2:00 o'clock P.M., notice of said public hearing heving been duly given as required by law and in acmrdance with the provisions of the Anaheim Municipal Code, Chepter 18.68, to hear and consider evidence for and against said proposed variance and to investigate and make finding's end recommendations in connection therewith; end l4HEREAS, said Commission, after due inspection, investigation, and study made by itself and in its behalf, and after due consideration of all evidence and reports otfered at said hearing, does find and deteanine the following facts: 1. The[ the petitioner requests a variance from the Anaheim Municipel Code. as the height of an existing sign on subject property: Heiqht of a free-standino sion. (P, maximum of 25 feet permitted when within 300 feet of a residential structure: 3~ feei pro~osed). ~ 2. That the riaiver of maximum sign height in close proximity to residential structures has been permitted only where the residences are non-conforming uses in the zone in which they are located, whereas a majority of the properties to the east of subject prooerty have been established as residential uses for some time and wi11, in all probability, remain as residential uses in the `uture; there.`or=, these homes should be af:orded protection from intrusion by non-conforming signs in the area. 3. 'Ihat the growth of trees in the area cannot be construed as justi:ication for approval o: variances for greater sign heights since ther= would be an unending number of reouests for higher signs as the trees grow taller. 4. That there ore no exceptional or extraordinary circumstances or conditions aoplicable to the property involved or to the intended use of the property that do not apply generally to the property or class of use in the same vicinity and zone. 5. That the requ.ested variance is not necessary for the preservation and enjoyment of a substantial property r.ight possessed by other property in the same vicinity and zone, and dehie to ihe prooerty in question. 6. That granting the requested sign height could set an undesirahl= precedent for similar requests from tne established comm~rcia] uses in close proximity, who have complied with the limitations of the Sign Ordinance. ?. That aoproval of variances .`rom the Sign Ordinance to bene.`it individual service stations that have not chosen to locate at prime locations, such as the intersection of tK~o zrterials, could have a deleterious effect on the adjacent residential land uses in close oroximity. ^ ',; N014, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby deny subject Petition far Variance on the basis of the aforementioned findings.
