PC 68-73~ ~ <~; , RESOLUTION NO, p~68-73 A RESOLUTION OF THE CITY PLANNIN(2 COMMISSION OF THE CITY OF ANAHEIM THAT PEiITION FOR CONDITIONAL USE PERiviiT 1:;^vy gE GRANTED WHEREAS, the City Plenning Commission of the City of Anaheim did receive a verified Petition for Conditionel Use Permit from ~~-I~RNIA LUTHERAN BIBLE SCHOOL, 1345 South Burlington Avenue, Los Angeles, California 90006, ar~nar; FRITH COMMUNITY BAPTIST CHURCH, 631 South Plestern Avenue, Anaheim, California 92804, Agent of certain real property situated in the City of Anaheim, County o.` Orange, State of California, described as the South one-half of the Northeast quarter of the Northeast yuarter of the Southwest quarter of S ection 14, in I'ownship 4 South, Range 11 V~est, in the Rancho Los Coyotes, City of Anaheim, as shown on a map thereof, recorded in book 51, page 7, et seq., Miscellaneous Maps, records of said Orange County ; and WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim on March 25~ 1968~ at 2:00 o'clock P.M., notice oE said public hearing having been duly given as required by law and in accordance with the provisions of the Anaheim Municipal code, Chapter 18.64, to hear end consider evidence for and against said proposed conditional use and to investigate and make findings and recommendations in connectian therewith; and WHEREAS, said Commission, efter due inspection, investigation, and study mede by itselE and in its behalE, and after due c~nsideration of all evidence and reports offered at said hearing, does find and determine the following facts: ~ A ~ 1. T}~at the propqsed use is properly one far which a Conditional.Use Permit is authorizedby Code: Se~tion 18.64.02011-b and c/ to wit: establish existing church facility as a con`orming use and to permit a day care, child nursery in an existing residential structure on subject property. 2. That [he proposed use will not adversely affect the adjoining land uses and the growth end development of the area in which it is proposed to be located. 3. That the size and shape of the site proposed for the use is adequate to allow the full development ofthe proposed use in a manner not detrimental to the particular area nor to the peace, health, safety, end general welfare of the Citizens oE the City of Anaheim. 4. That the granting oE the Conditional Use Permit under the conditions imposed, if any, will not be detrimental to the peace, health, safety, and general welfare of the Citizens of the City of Anaheim. That the owner of subject property shall pay to the City of Anahei--: the sum of $2.00 per front foot alony Wes`ern Avenue, for street lighting purposes. 2. That the owner o, subject property shall pay to the Clty of Anaheim the sum of 19Q oer .`ront foot along Western Avenue, for tree planting purooses. 3. That trash storage areas shall be provided in accordance with approv2d plans on file with the office of the Director of Public Works. 4. That a modified cul-de-sac be provided at the terminus of Courson Drive s~_ibject to the aoproval of the City Engineer. ~'-~"~ 5. That the vehicular access rights to Courson Drive shall be dedicated to the City of ~~' Anaheim. ~~ o. That fire hydrants shall be installed as required and determined to be necessary by ~i% the Chief o: the Fire Deoartment. l ~` 7. Tnat any air-conditioning facilities proposed shall be properly sh;elded from view, i and the sound shall be buffered from adjacent residential homes. ' 8. That all external lighting shall be directed downward and away from abutting property ~ lines. •~ 9. That Condition Nos. 1, 2, 3, 4, 5, 6, 7, and 8, above mentioned, sha11 be comolied with ~ -; prior to the time that the day school use may commence. I : 10. That an insoection shall be made o: the premises by reoresentatives of the Cit y of ,,= Anaheim to determin e t h e c u r r e n t s t a t u s o f a l l s truc tures located on subject prooerty and how they conform to the minimum standards o` the Uniform Building, Electrical, and Plumbing Codes .~I as adooted by the City of Ananeim and all fire safety regulations of the City of Anaheim.
