A ~ i~ RESQLUTION N0, PC68W84 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM THAT PETITION FOR CONDITIONAL USE PERMIT N0. 1008 _ BE GRANTED WHEREAS, the City Planning Commission of the City of Anaheim did ceceive a verified Petition for Conditiona( ?;-' Use Permit from AUBREY ~NDERSON, 2947 West Lincoln Avenue, Anahaim, California 92801. Owner; ';' U-DRIV~ KARTS, ING~ORPORATED, 9521 Lampson Avenue, Garden Grove, California 92641, Ag ent of ~ certain real property situated in the Cit~ of Anaheim, County of Orange, State of California, described in Exhibit "A" attached hereto and referred to herein as though set forth in full T~ . ; and WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in th~ City of Anaheim on MarCh 25~ 1968, at ~~ 00 o'clock P.M., notice of said public hearing ha~~ing been duly given as require~i by law and in accordance with the provisions of the Anaheim Municipa! code, Chapter 18.64, to hear and consider evidence for and agair.st said proposed conditional use and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Commissiun, after due inspection, investigation, and study made by itself and in its behalf, and aftet due consideration of all evidence and reports offered at said hearing, does find and determine the following facts: 1. That the proposed use is propedy one for which a Conditional Use Permit is authorized by ~ode: S~ction 18.64.020(3-j-6) to wit: expand an existing "go-kart" rental facility with sales and service on subject property. 2. That the proposed use will not adversely afrect the adjoining land uses and the growth and development of the area in ivhich it 5.s oroposed to be located, since it has been in existence for seven years, and the proposed expansion ~vill constitute a substantial im- provement and upgrading of the existing facility. 3, Thal the size and shape of the site proposed for the use is adequate to allow the full development of the proposed use in a manner not detrimental to the particular area nor to the peace, health, safety, and general welfare of the Citizens of the City of Anaheim. 4. That the granting of the Conditional Use Pennit under the conditions imposed, if any, wili not be detrimental to the peace, health, safety, end general welfare of the Citizens of the City of Anaheim. 5. That a petition signed by 131 trailer park residents opposing the existing "go-i;art" facility was received, which prompted the Commission to require a new public hearing. 6. That the owner of subject property shall pay to the City of Anaheim the sum of 15¢ ~ per front foot along Lincoln Avenue, for tree planting purposes, prior to the time that the ~~ Building Permit is issued or within a period of 180 days from date hereof, whichever occurs first, or such further time as the Commission or City Council may grant. 2. That trash storage areas shall be provided in accordance with aoproved plan~ on file with the office of the Director of Public Works. 3 3. 7hat any air-conditioning facilities proposed shall be properly shielded from view, ~ and the sound shall be buff ered from adjacent residential homes. ', 4. Tnat all exterior lighting shall be directed dowrnti~ard and away from abut±ing orooerty ; ~4 lines. ` 5. That Condition Nos. 2, 3, and ti, above mentioned, shall be comolied with orior to 1~ final building and zoning inspections. ~ 6.
