PC 68-89. •t f PC68-89 RESOLUTION N0, A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANANEIM THAT PETITION FOR CONDITIONAL USE PERMIT N0. 1021 gE GRANTED WHEREAS, the City Planning Commission of the City of Anaheim did receive a verified Petition for Conditional Use Permitfrom EUCLID SHOPPING CEM'ER, 2293 West Ball Road, Anaheim, California 92804, Owner; H. RALPH LOV~1'T, 4921 Durfee Avenue, Pico Rivera, California 90660, Agent of certain real property situated in the Ci•ty of Anaheim, County of Orange, State of California, described as, parcel 1: Lot 4 of Townsend s Subdivision, as shown on a map thereof recorded in Book 5, paqe '` 40, Miscellaneous Maps. Parcel 2: Lot 9 of Townsend's Subdivision as shown on a map thereof recorded in Book 5, page 40, Miscellaneous Maps, records of Orange County. Parcel 1: Lots 3 and 4 of Townsend's Subdivision, as shown on a map thereof, r ecorded in book 5, page 40 , Miscellaneous hiaps. FXCEPTING FROM said Lot 3, the West 203 feet of the North 210 feet thereof, ; measured to the canterline of streets. Parcel 2: Lot 9 of Townsend's Subdivision, as shown on a map thereof, i•ecorded in book 5, page 40, Miscellar.eous iviaps, records of Orange County ; and WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim on Aoril 8~ 1968, at 2:00 o'clock P.M., notice of said public hearin havin been dul B B y given as required by law and in accordance with the provisions of the Anaheim Municipa] code, Chapter 18.64, to hear and consider evidence ~ for and agair.st said pcoposed conditional use and to investigate and make findings and recommendations in connection i : therewith; and _ WHEREAS, said Commission, after due inspection, investigation, and study made by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and determine the follo wing facts: 1. That the proposed use is properly one for which a Conditional Use Permit is authorized by Cod'c: 5c;:tion if3.40.060(g) to wit: to oermit on-sale liquor in conjunction ~ith a proposed restaurant on subject property. i ~;-:i _ E ~ .. r::1; - -`;~+r'„Y~,.'+. I 2. That the proposed use will not adversely affect the adjoining land uses and the growth and development of ~ the area in which it is proposed to be located. I 3. That the size and shape of the site proposed for the use is adequate to allow the full development of the ~ proposed use in a manner not detrimental to the pac~ cular area nor to the peace, health, saFety, and general welfare of , the Citizens of the City of Anaheim. That the granting of the Conditional Use Permit under the conditions imposed, if any, will not be detrimental j- to the peace, health, safety, and general welfare of the Citizens of the City of Anaheim. I : l ~ ~ ~ 'I ~x C1.G -1- \ ~ ~ NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby grant subject PetItion for ConditIonel Use Permit, upon the followIng conditions which are hereby found to be e necessery prerequisite to the proposed use of the subject property in order to preserve the sefety end general welfare of the Citizens of the City of Anaheim: 1. That this conditional use permit is granted subject to the comp_etion or Reclassificatio~ PJo. 65-66-105. 2. That any air-conditioning facilities proposed shall be properly shielded from view, and the sound shall be buff ered from adjacent residential homes. 3. That all exterior lighting shall be directed downward and away from abutting property lines. 4. That Condition Nos. 2 and '3, above mentioned, shall be complied with prior to final building and zoning inspections. 5. That subject property shall be developed substantially i~i accordance with plans and specifications on file with the City of Anaheim, marked ~xhibit Vos. 1, 2, 3, and ~, nrovided that all C-1 site development standards are complied with. f . ~ i ( 4 ~ .
