A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM THAT PETITION FOR VARIANCE NO. 1968 BE GRANTED WHEREAS, the City Planning Commission of the City of Anaheim did receive a verified Petition for Variance from FRANK L. TAYLOR, 12250 East 216th Street, Hawaiian Gardens, California 90701, Owner; R. L. COONS, P.O. That the petitioner requests a variance from the Anaheim Municipal Code: Chaoter 18032, in o: der to establish a ~ar rental and service far,ility on subject oroperty. 2. That there are exceptional or extraordinary circumstances or conditions epplicable to the property involved or to the intended use of the property that do not apply generally to the property or cless of use in the same ~~icinity and zone. 3. That the requested variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone, and deni~d to the ptoperty in question. 4. That the requested varience will not be materially detrimental to the public welfore or injurious to the prop- erty or improvements in such vicinity and zone in which the property is located. 5. That a 6C0 room high rise addition :s proaosed for the oroperty immediately to tne east of subject croperty, thus the use pi•oposed would seem to be appropriate as an ir,-ident"_ use to the area. o. That the owner of subject property shall deed to the City of Anaheim a=_trip of ].and 45 feet in width, from the centerline of the street, along Cerritos Avenue and iNalnut S;,reet, including a 25~foot radius corner return, for street ~.~dening purposes. 2. That trash storage areas shall be provided in accordance with aoproved plans on file with the office of the Director o~ Public Works. 3. That any air-conditioning facilities proposed sha'.1 be properly shielded from view,and the sound shall be buffered from acijacent residential ho~es. 4. That all exterior lighting shall be directed downward and away from abutting property lines. 5. That ~ondition No. 1, above mentioned, shall be complied with prior to the tirne that the Building Permit is issued or within a period of 180 days from date hereof, whichever occurs first, or such fiither time as the Commission or City Council may grant. 6. Thzt Condition Nos. 2, 3, and 4, above mer~tioned, shall be complied with prior to final building and zoning inspections. 7. That subject property shall be developed substantially in accordance with olans and specifications on file with the City of Anaheim, marked Exhibit Plos. 1 and 2.
