A RESOLUTION OF THE CITY Pi,ANNING C01'IMISSION OF THE CITY OF ANAHEIM THAT PETITION FOR VARIANCE NO. 2032 BE DENIED ~ , ~~ ~R ~ .~` WHL~EAS, the City Plenning Commiasion of the City of Aneheim did receive a veeified Petition for Vedence from GIACOMO AND AGOSTINA LUGARO, 420 North Magnolia Avenue, Anaheim, California 92801, ?wness; STAI4DARD OIL CAMPANy, WESTERN OPERATIONS, INCORPORATED, P, 0. Box 719, Orange, California 92667, Agent of certain real property situated in the City of Anaheim, County of Orange, State of , California, described as the North 195.00 feet of the West 200.00 feet of the Northwest quar"ter of the Southwest quarter of Section 7, in Township 4 South, Range 10 West, in the Rancho Los Coyotes, as said section is shown on a Map recorded in Book 51, Page 10 of Misce'_laneous Maps, in the office of the County Recorder of said County. ; and WHEREAS, the Clty Planning Commiseion did hold a public heodne at the CIty Hall in the City of Anaheim on January 13, 1969, et 4:00 o'clock P.M., natice of aeid public headng heving been duly Qiven ea required by law end In eccordence with the provisians of the Aneheim Munirlpai Code, Chepter 18.68, to hear and coneider evidence for end egeinst said pcopoaed variance end to investigete end mekr findings ou~d recrommendation~ in connection therewith; and WHEREAS, eaid Commission, efter due inapection, Investigetlon, and study made by itself end in :ts behalf, end efter due consideration of all evidence and mporta olfered at said heering, doea find end detecsnine the following fects: 1. Thet the petitioner requests e varience from the Aneheim Municipel Code as follows, to permit the establishment of an additiona'_ fre2-standing sign to be used as a price sign: SECTION 18.62.090(b-11 - Maximum number of free-standinq sians. tOne free-standing sign permitted; three free-standing sians existing and proposed). SECIION 18.62.090(b-1) - Minimum distance between free-standina sians. (300 feet required; 64 and 143 feet proposed). 2. That the petitioner did not submit evidence to warrsnt the Commi.ssion's considering subject petition favorably, since no hardshio was demonstrated that an additional :ree-standinq sign was necessary to en.joy substantialiy the same rights as other service stations had in the City. 3. That approval of subject petition wouid set an undesirable precedent for requests from other service stations located throughout the City, as well as other commercial operations, to permit additional free-standing signs, thereby negating any effect the si9n ordinance would have on maintaining adequate signing without creating undesirable visibility distractions. 4. That the Commission could be faced ~uith processing variance requests from 231 other service station operators which could amount to a considerable expense for the City, while the • oil company could resolve their pr~sent predicament by redesigning the existing 26 signs s'o that they are not advertising siyns, per se, at less expense than the City would incur in processirtg 231 variance petitions. 5. That there are no exceptional or extraordinary circumsta~ces or conditions applicable to the propert•y invoved or to the intended use of the property that do not apply generally to the property o.r. class or use in the same vicinity and zone.
