T ~~ ~ . ,a -_'~ RESOI.UTION N0. ~'~69-:.09 ' A RESOLUTION OF THE CITY PLANNIIdG COMB'IISSIOiV OF' THE CITY OF ANAHEIM 1'HAT PETITION FOR VARIANCE NO._ 2089 BE GRANTED WHEREAS, the Clty Planning Commission of the City of Maheim did receive a verified Petition for Varience from SECURITY TITLE INSURRNCE ~MPANY, 825 North Broadway, Santa ,Ana, California 92701, Owner; Rl6SELL MC Caleb, 3350 North Central Avenue, Suite 723, Phoenix, Arizona 85012, Agent of certain real property situated in the City of Anaheim, County of Orange, State of California, described as Lots 1 through 7, inclusi.ve, of the R-~gier Subdivision, as shown on a Map recorded in Book 6, page 37, Miscellansous Maps, records of Orange County, and Lots 4, 5, 7, 9, 12, 13 and 14, in Block C of Davis Brothers Ada~tion to Ar.aheimy as shown on a Map recorded in Book 2, pages 632 and 633 of Miscellaneous Records of Los Angeles County. EXCEPTIIJG from said Lots 12, 13 and 14, the Westerly 10.00 feet now included within Harbor Boulevard, formerly Palm Street. ; and WHCREAS, the City Planning Commisslon did hold a public hearing at ffie City Hall in the City of Anaheim on May 19, 1969, at 2:00 o'clock P.M., notice of seid public hearin hevin 6een dul by law end in accordance with the provisions of the Maheim Municipal Code, Charrter 18.68, to hear andeconsideruev a dence for end egainst said proposed veriance and to investiqate and meke findings and recommendetions in connection therewith; end WHEREAS, saiti Commission, efter due inspection, investigetion, end study made by itself and in its behalf, and after due consideration oE ail evidence and reports offered at said heuring, does find and detecmine the follo wing fects: 1. That the petitioner requests o veriance from the Anaheim Mtu~icipal Code as follows ~ to permit the establishment of a 10-story office structure on subject property. Thet there are exceptional or extraordinary circumstences or conditions appliceble to the property involved or to the intended use of the property that do not apply generelly to the property or class of use in the seme vicinity and zone. 3. That the requested veriance is necessery for the preservation end enjoyment of a substantiel property right possessed by other property in the same vicinity and zone, and denied to the property ;n question. 4. Thet the requested verience will not be meterially detrimentel to the public welfare or injurious to the prop- erty or improvements in such vicinity and zone in which the property is loceted. 5. That the petitioner stipulated to the construction of parking structure fourdations sufficient to support a fifth level of parking, although 4-stories or levels are to be con- structed at the pre~e;,t time. Vl-G .~. _._.~ ~ I . • ~ NOW, THEREFORE, BE iT RESOLVED that the Anaheim City Planning Commission does hereby grant subject Petition for Variance, upon the following conditions which are hereby foand to be a necessary prerequisite to the pro- posed use of the subject property in order to preserve the safety and general welf.are of the Citizens of the City of Anaheim. 1. That this variance is granted subject to the completion of Reclzssification No. 65-66-62. 2. That trash Storage area~ shall be provided in acco*dance with approti•ed plans on file wi±h the office of th~ Director of Public Works. 3. That fi•re hydrants shall be installed as required and dete*mined to be necessary by the Chief of the Fire Departmeni. 4. That the sidewalks, ~urbs and gutters shall be removed and/or reconstructea along Broadway, Helena Street and Elm Street, as required by the City Engineer and in accordance a with standard plans and specificatinn= on filein the office of the City Engineer. ~ 5. That any air-conditioning facilities proposed shall be pxOperly shielded from view, and the sound shall be buffered from adjacent residential homes. 6. That any parking a*ea lighting shall be lighted with down-lighting a maximum 5-fee~~ in height and shall be directed away from the property lines to protect the residential integrity of the area. 7. That a bond in an amount and form satisfactory to the City o` Anaheim shall be posted to guarantee construction of a 5th storv, if within 30-36 months after issuance of a Building Permit the City, upon review of the parking situation around subject property, determines that additional parking in con~ormar.ce with parking requirements of the C-0, Commercial Office, Zone shoulr3 be provided. 8. That the pe'titioner shall provide employee parking, either on-site or off-street parking within 750 feet of subject property. 9. That Condition Nos. 2, 3, 4, 5, 6, 7, and 8, above mentioned, shall be complied with prior to final buildina and zoning inspections. 10. That subject property shall be developed substantially in accor;;ance with plans and specifications on file wi~h the City of Ar.aheiin, marked cxhibit P~os. 1, 2, 3, 4, 5, ano 6, provided however, that the proposed parking struct+are foundati~n shall be auequate to support a 5-story structure.
