LENZ~ ET AL, 930 South State College Boulevard, Anaheim, California 92806, Owner; NATHAN SHAPELL, 8857 West Olympic Boulevard, Beverly Hills, California 90211, Agent of certain real property situated in the City of Anaheim, County of Orange, State of California, described: The northwest quar{er of the southeast quarter of the northwest quarter and the west 11.00 ~:~ feet of the northeast quarter of the southeast quarter of the northwest quarter and the ~ southeast quarter of the southwest quarter of the northwest quarter and the northeast quarter of the southwest quarter of the northwest quarter of Section 13 township 4 south~ range 10 west~ in the Rancho San Juan Ca'on D$ of California aS J e anta Ana~ C~{y of Anaheim~ county of Orange~ State of the countv~record=rmof saidreoun{y~book 51 page 10 of miscellaneous maps~ in the office ; and WHEREAS, the City Plenning Commission did hold a public hearing at the City }{all in the City of Aneheim on _ May 19~ 1969~ at 7:30 o'clock P.M., notice of said ublic hearin hevin been dul law andin acoordence with the provisions of the Anaheim Municipal Code, Chapter 18.68, to hear and consider evidence for and ageinst said proposed variance and to invesligate and make findin s y~°en as required by ~d B and recommendafions in conaection therewith; WHEREAS, said Commission, efter due inspection, investigation, and study mnde by itself and in its behalf, and efter due consideration of all evidence and reports otfered at said hearing, does find and detertnine the following facts: 1. That the petitioner requests a verience from the Aneheim Municipal Code as follows, to permit the development of a 175-1ot subdivision with reduced structural setbacks of 4~- feet and 14z feet, and to have 30% of the lots with greater than Code permitted lot coverage. That the requested variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone, and denied to the proparty in question. 4. That the requested variance will not be materially detrimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property ~ is located. I 5. That the petitioner stipulated a maximum of 30~ of the lots shall exceed the maximum lot coverage of 40;K, I 6. That seven persons appeax•ed, repre,enting twelve persons present in the Council Chamber, a11 in opposition to subject petition. ~'~ Vl_D :~~ ~ ~ ;~ ' ,:, ~ -1- ~ ~ .. ~• ~ NOW, THEREFORE, BE IT RESOLVED th:~t the Anaheim City Planning Commission does hereby grant subject Petition for Variance, upon the following conditions which are hereby found to be a necessary prerequisite to the pro- posed use of the subject property in order to preserve the safety and general welfare of the Citizens of the City of Anaheim. 1. That this variance is gxanted subject to the completion ot Reclassification No. 68-69-91. 2. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim, marked Exhibit Nos. 1, 2, 3, and 4; provided, however, that a maxi.mum of 3(3,K of the lots may exceed the maximum of 40% lot coverage, as stipulated by the petitioner. ~ . ;-.
