A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM THAT PETITION FOR VARIANCE N0. 2081 gg APPROVED WHEREAS, the City Planning Commission of the City of Anaheim did receive e verified Petition for Variance from HARE T. KISHIYAMA, 16507 Gramercy Place, Gardena, California 90247, Owner; Ni~LLIAM PHELPS, 914 East Katella Avenue, Anaheim, California, Agent of certain real property si;uated in the City of Anaheim, County of Oranae, State of California, described as the south t;aic of the north 198.00 feet of the south 483.OQ feet of the south half of the east half of the r.ortheast quarter of the northwest quarter of section 14, township 4 south, range 11 west, in the Rancho Los Coyotes, as said section is shown on a map.recorded in Book 51, Page I1 of Miscellaneous Maps, in the office o: the County Recorder of said County. Said land is included viithin the area of the Map filed in Book 36 Page 22 of Record of Surveys, in the office of said County Recorder. ; and WHEREAS, the City Planning Commission did hold e public hearing at the City Hall in the City of Aneheim on June 2, 7969~ at 2:00 o'clock P,M., notice of seid public hearing heving been dul law andin accorda~ce with the provisions of the Anaheim Municipal Code, Chapter 18.68, to hear and cons der evidence for and against said proposed vaiience and to investigate end mal:e findings and reccaimendations in connection therewith; and WHEREAS, said Commission, efter due inspection, investigation, and s;udy made by itself and in its behalf, end aEter due consideretion of all evidence and reports offered at said hearing, does find and determine the following fects: 1. Thet the petitioner requests e variance from the Anal~eim Municipel Code: to establish a 40-unit apartment complex, with waivers of: lj SECTION 18,280050(5-b) - Maximum b_u_ildina heiqht within 150 feet of R=A zoned qropertv. (One-storv within 150 feet; four two-starv units to within 106 feet proposed). 2i SECTION 18,28.050(6-b-•2) - Minimum side vard setback. (13 feet required; 10 feet proposed for private patios). 3) S ECTION 18,28.050(6-b-3) - Minimum side ~ard setback. (5-feet required; ~-feet proposed for carports). 4) SECTION 18„28.050(9-a) - Adeguate access for '.ire and trash vehicles . (Adequate access reyuirac'; less than adequate ac:cess proposed), 5) S ECTION 1IIs28.U50(9-b) - Distance of livina units from a standard street . (within 20C feet required; 34 units up to 490 feet distance proposed). 2. That there ar~ exceptionaZ or extraordinary circumstances or conditions applicable to the property involved or to the intended use of ths property that do not apply generally to the property or class of use in the same vicinity and zone. 3. That the requested variance is necessary for the preservation and enjoymer.t of a substz~~tial property right possessed by other pro~erty in the same vicinity and zone, and denied to the property in question. 4, That the requested variance will no± be materially de±rimental to the public welfare or injurious to the property or improvements in such vicinity and zone in which the property is located. 5. That since the applicant submitted revised F].ans indicating adequate access for fire and trash vehicles, it was determir~ed by the Pianning Commission that Waiver No. 4 is no longer necessary. 6. ' 1. That this variance is granted subject to the completion of Reclassification No. ~ 68-69-89. ` 2.
