HARRY KNISELY, 1741 South Euclid Street, Suite B, Anaheim, California 92802, Agent of certain real property situated in the City of Anaheim, County of Orange, State of California, describe~ as the North half of the Northe.=.sy quarter of the Southwest quarter of Section 7, To~mship 4 South, Range 10 West in the Rancho I.os Coyotes, as shown on a Map recorded in book 51, page 10 of MiscellanE~ous Maps, records of Orange County. Excepting therefrom that portion lying 5outh- erly of a line paiallel and concentric with and distant Idortherly 39.50 feet from the follovaing destribed line; Reginninq at a point in the Easterly line of said Southwest quarter, said point being distant South 0~ 37' 35" East 668.94 feet from the Northeast corner of said Southwest quarter; thence South 88~ 40' 21" West 708.56 feet to the beginning of a tangent curve concave Southerly having a radius of 12G0.00 feet; thence Westerly and Southwesterly along said curve to a point in the West line of the ?dortheast quarter of said Southwest Quarter. ; and WHEREAS, the City PlenninR Cr,nmission did hold a public hearing at the City Hall in the City of Aneheim on June .2, 1969, at 2:G0 o'clock P.M., notice of said ublic hearin havin been dul P B B y given as required by law end in accordance with the provisions of the Anaheim Municioal code, Chapter 18.64, to hear and cansider evidence for and egair.st seid proposed conditional use and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Commission, efter due inspection, investigation, end stndy made by itself end in its behalf, and after due consideration of ell evidence and reports offered at said hearing, does find and detem~ine the following facts: 1. That the proposed use is properly one for which a Conditional Use Pertnit is authorized by Coae: Section 18.64.020(2-d), to establish a 15?_ space, adult mabile home pask. 2. Thet the proposed use will not edversely aEfect the adjoining land uses end the growth and develupment ot the area in which it is proposed to be located. 3. Thet the size and shape of the site proposed Eor the use is adequate to allow the full development of the pivposed use in a manner not detrim ental to the particular area nor to the peace, health, safety, and general welfare of the Citizens of the City oC Anaheim. 4. Thet the granting of !he Conditional lise Peimit under the conditions imposed, if any, will not be detrimentel to the peace, health, safety, and generai welfare of the Citizens of the City of Aneheim. 5. That a petition with 49 signatu.res was presented requesting a postponement of the proceedings for the proposed mobile home park in order to give adjacent p.rope:ty owners additional time in which to review the proposed plans for development. However, since the Planning Commission determined that the proposed use was appropriate for the subject property and felt an obligation to expedite zoning petitions wherever reasonably possible, the Commission determined that a postponement of the conditional use permit would not be necessary. Fu:thermore, si~ce the agent for the applicar~t offered to post the $50 appeal fee for a public hearing before the City Council in the event any or the interested parties in the area desired to appeal this matter, the Planning Commission agreed to accept the appeal fee. 6. NOW, THEREFORE, AE IT RFSOLVED that the Anaheim City ?ianniny Commission does hereby grant subject Petiticn for Co~~ditional Use Permit, upon the follo~iing conditions aahich are hereby found to be a necessary prerequisite to the propose;; use of the subject property in order to preserve thc eafety and gencral vrelfa:e of the Citi~en= of the City of Anaheim. 1. That street improvement plans shall be prepared and ali engineering requirements of the City of Anaheim along Crescent Avenue and Gilbert S~reet, such as curbs and gutters, sidewalks, street aradina and paving, drainage facilities, or other appurtenant work shall be completed as required by the City Engineer and in accordance with standard plans and specifications on file in the of'ice of the City Engineer; and t'~at a bond in an amourt and :orm satisfactory to the City of Anaheim shall be posted v~ith the City to guarantee the installation of said engineering requirements. 2. That the owner of subject property shall pay to the City of Anaheim the sum of 15¢ per iront foot along Crescent Avenue and Gilbert Street, for tree planting purposes. 3. That the owner of subject property shall install street lighting along Crescent Avenue and Gilbert Street as reouired by the Director of Public Utilities and in accordance with standard plans and specifications on file in the office of the Director of Public Utilities; and that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarar.t.ee the installation of said street lighting. 4. That trash storaae creas shall be provided in accordance with approved plans on file with the office of the Directo: of Public Works. 5. That fire hydrants shall be installed as required and determined to be necessary by the Chief of the Fire Department. 6. That a 6-foot masonry ~;~a11 shall be constructed along the west, north, a~d east property lines. 7. That any air-conditioning facilities proposed for any permanent structures shall be preperly shielded from vie~v, dnd the sound shall be buffered from adjacent residential homes. 8. That Condition tJos. 1 and 2, above mentioned, shall be complied with prior to the time th~t the Building Permit is issued or within a period of 180 ~ays from date hereof, whichever occurs first, or such further time as the Commission or City Council may grant. 9. That Condition Nos. 3, 4, 5, 6, and 7, abo~~e mentioned, shall be complied with prior to final building and zoning insoections. i0. That the owner of subject property shall pay to ~h~ City of Anaheim, Naric and recreation fees of $50 per ~r~iler space as reouired by City Council Resulution, vahich shall be used for park and recreat:on purposes, said amount to be paid at the time the Huilding Permit is issued. 11. That the proposed develoament shall be i~ accordance with the requirements o: the State Trailer Act, and that nl~mbing shall be provided in o:der that the mobile home park will accommodaLe all trailers and not be restricted to "Ca!ifornia approved trailers" only. 12. That subject property shall be developed substa~tially in accordance wi±h p:ans and specifications on file with the City of Anaheim, marked ExhiEit Nos. 1, 2, and 3. 13. That a 6-foot chain link fence, satisfactory to the Orange Count}~ Flood Control District, be provided along the south boundary of subject property prior to final building and zoning inspections. 14. That sub~ect property shall be provided vaith underground utilities.
