A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM THAT PETITION FOR VARIANCE N0. 2~92 BE GRANTED WHEREAS, the City Pienning Commission of the City of Anaheim did receive a verified Petition for Vadance from DOWNEY SAVINGS AND LOAN ASSOCIATION, P, 0~ Box 3760, Fullerton, Cali:ornia 92634, Owner of certain real property situated in the City of Anaheim, County of Qrange, State of California, described as Lot Nos. 36, 37, 38, 39, 40, 41, 42, and 43 of Tract Noo 6820 ; end WHEREAS, the City Planning Commission did hold a public hearing et the City Hall in ffie City of Aneheim on June 2, 1969~ at 2:00 o'clock P.M., notice of said public hearing having been duly given as required by lew and in e~cordance with the pmvisions of the Maheim Municipa! Code, Chaptet 18.68, to hear and consider evi- dence for and against seid pmposed varience and to investigete and make findings and recommendettons in connection therewith; end WHEREAS, said Commission, after due inspection, investigetion, end study mede by itself end in its behelf, end after due consideaeUon of all evidence and reports offered at said hearing, does find end detecmine the following facts: 1. That the petiUoner request3 a variance from the Maheim Municipal Code: with waiver of SeCtion 18.24.03U(1-a) - Minimum front yard setback. (25 feet required; 20 feet proposed). 2. That there are exceptionel or extraordinary circum stances or conditians epplicable to the property involved or to the intended use of the property thet do not apply generelly to the property or clase of use in the seme vicinity and zone. 3. Thet the requested veriance is necessary for the preservation and enjoyment of e substential property ri t posseased by other ptoperty in the same vicinity end zone, and denied to the propetty in q,uestion. ~ 4. That the requested verience will not be materially detrimentel to the public welfere or injurious to the pmp_ erty or improvements in such vicinity and zone in which the property is located. 5. That approval of the variance as requested would provide front yards on subject parcels consistent with the remainder of the subdivision and would provide greater separation between subject property and the R-1 tract to the east. 6. That one person ap~eared in opposition. That this variance is granted subject to the completion of Rec].assification No. 66-69-55. ~ 2.
