A RESOLUTIONi OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM
THAT PETITION FOR VARIANCE N0. 2093 BE DENIED

SEVEI!TH P~.r ADVENTISI5, 9707 Magnolia Avenue, Riverside, California 92503, Owner; APOLLO DEVELOP-
MENT CORPORATION, 1104 East 17th Street, Santa Ana, California 92701, Agent of certain real
property situated in the City of Anaheim, County o: Orange, State of California, described as
the East half of the Southeast quarter of the S outhwest quarter of Section 13, Township 4 South,
Range 10 West, Szn Bernardino Base and Meridian. EXCEPTING therefrom the North 665 feet. Also
excepting therefrem the S outherly 203 feet of the Easterly 265 feet. Also excepting therefrom
that portion described in the Deed to the County of Orange, recorded March 23, 1967, in Book 8206,
Page 203 of Offical Records, in the office of the Recorder of said Orange County. Portion A.

WHEREAS, the Ctty Pl~nning CommissIon did hold e public headng at the City Hall in the City of Anaheim on
June 2~ 1969~ ct 2:00 o'clock P,M., notice of soid public heering having been dul
law end in accordance with the proviaions of the Anaheim Municipal Code, Chopter 18.68, to hear and cons der evidence or
and against said proFoaed votience and to Investl6ote end make findings end recommendetions in connectian thzrewith;
and
WHEREAS, said Commtssion, efter due inspection, investigetion, and study mede by itself end in its behelE,
and efter due consideration of ell evidence end teports offered a't said hearing, does find end detecmine the following
facts:
1. Thet the petitioner requests a variance from the Aneheim Municipal Code, to establish a 196-unit
apartment complex (Portion P.), with waivers of:
1) SECTIO~! 18.32.020(1) - ~§aximum number of main buildinas on a site. (Two
main buildings permitted; 19 main buildings proposed).
2) SECTION 18.28.050(5-b) - PAaximum buildinq heioht within 150 feet of R A or
sinqle-fanily zoned propertv. (One-storv permitted;
two-story proposed).
3) S~.CTION 18.28,050(6-b-3) - Location of accessor buildin s. (5-foot setback
required; 0-feet pioposed .
4) SEC7ION 18.28.050(7-a) - Minimum distance between buildinqs. (13 feet re-
quired; 8-feet proposed in several instances).
5} SECTION 18.28,050(10-a) - Minimum number of reouired covered parkinq sqaces.
(246 covered spaces required; 205 covered sqaces

2. That there are no exceptional or extraordinary circumstances or condi~iions applicable
to the property involved or to the intended use of the proper.ty that do apply generally to
the property or class of use in the same vicinity and zone.
3. That the requested variance is not necessary for the preservation and enjoyment of
a substantial property right possessed by other property in the same vicinity and zone, and
denied to the property in question.
4. That the requested variance will be materially detrimental to the public welfare or
injurious to the property or improvements in such vicinity and zone in which the property is
located.
5. That due to the fact the proposed reclassification for R-3 zoning was recommended
for denial, the waivers requested under Variance No. 2093 would not be applicable.

NOW, THEREFORE, BE IT RESOLVED tha: the Anaheim City Planning Commission does hereby deny subject
Petition for Vetiance on the basis af the eforementioned findings.
