That the petitioner requests a varience from the Anaheim Municipel Code as fol lows, to establish a two- story, 24-unit apartment development on subject property: SECTION 18.28.05Q~5-h) - Maximum buildin4 heinht. (One-storv within 150 feet of an . R-A Zon~ permitted; all two-storv units 10 to BO feet from an R-A Zone proposed), ~.; _ ~EGTION 18.~8,050 7-a - Minimum distance between buildinas. That the Commission grants the i•equest of the petitioner to withdraw the waiver of the minimum floor area per dwelling unit. 3. That there are exceptional or extraordinary circumstancES or conditions applic.:,ble to the property involved or to the intended use of the property that do not apply generally to the property ~r class of use in the same vicinity and zone. 4. That the requested variance is necessary for the pre~ervation and enjoyment of a substantial property right possesseJ by other property in the same vicini;y and zona, and ;ienied to the property in question. 5. S 1. That this variance is granted subject to the completion of Reclassification tdo. 68-69-63. ~ 2. That the side~valks shall be installed along Magnolia Avenue, as required by the City Engineer and in accordance vaith standard plans and specifications on fil~ in the ofFice of the City Engineer. 3. That trash storage areas shall be provided in accordance with approved plans on file with trie office of the Director of Public Works. 4. That fire hydra~ts shall be installed as required and determined to be necessary j~ by the Chief of the Fire Department. 5. Drainage of subject parcel shall be discharged in a manner which is satisfactory Y=! to the City Engine2r. :; 6. That any air-ccnd3tioning facilities proposed shall be properly shielded from view, ~?:. and the sound shall be buffered from adjacent residential homes. j:•>~ 7. That any parking area lighting sha:l be with down-lighting a maximum 6-feet in heiyht and shall be directed away from th~~ ~roperty lines to protect the residential integrity of the area. :t 8. That a bond in an amount and form satisfactory to the City of Anaheim shall be ; posted ovith the City to guaran~ee ~i;e installation of a 6-foot masonry wall along the north ~~ property linee ~'~ 9. That Condition Nos. 2, 3, 4, 5, 6, 7, and 8, above mentioned, shall be complied ~y with prior to final buiiding and zoning inspections. ~ 10.
