J j ~ ep- { ~ t ,d~ ~.~ .. ~ -.._., ~._r RESOLUTION TO. 1 PC69-140 A RESOLUTION OF THE CITY PLANNING COh]MISSION OF THE CITY OF ANAHEIM THAT PETITION FOR VARIANCE NO. 2~96 BE GRANTED WHEREAS, the City Planning Commission of the City of Aneheim did receive a verified Petition for Varience from DUNN PROPFR~IES CORPORATION, 2019 South Ritchey Street, Santa Anay California 92705, Owne*i GLIDDEN-DURFEE, JQ~Fa^, AREA MANAGER, 6948 Bandini Boulevard, Los Angeles, California 90022, Agent of certain real property situated in the City of Anaheim, County of Orange, State of California, described as that portion of the North half of the I4ortheast quarter, of the North- east Quarter of Section 23, To~•mship 4 South, Range 10 West, in the Rancho San Juan Cajon De Santa Ana, shown as parcel 12 on a Map filed in Book 21, Page 4 of Parc~1 ~vlaps in the office of the County Recorder of said County~ ~ ; and WHEREAS, the City Planning Commission did hold a pub!ic hearing at the City Nall in the City of Anaheim on June 30' 1969' at 2:00 o'clock P.M., notice of said public hearing having been duly giver as required by law and in accordence with the provisions of the Aneheim Municigal Code, Chepter 18.68, to hear and consider evi- dence for end egainst said proposed varience and to investigate and make findings and recommendations in connection therewith; and WHEREAS, seid Commission, after due inspection, investigetion, and study made by itself ond in its behalf, end after due consideration of all evidence and reports offered at said hearing, does find end deteenine the following fects: 1. That the petitioner requests a varience from the Anaheim Municipel Code, as follota~s~ to permit :?tail sales in conjunction with an indust:ial wholesalinq establishment on subject property. SECTIOfJ 18~52.020 - Permitted M-1 Uses. (Wholesaling of goods not produced on the premises permitted; retaii sales to the general public not permittedl. 2. That there are exceptional or extraordinery circumstances or conditions upplicnble to the properly inrolved or to the intended use of the property that do not apply generally tu the propecty or closs of use in the same vicinity and zone. 3. That the requested veriance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the sem e vicinity and zone, and denied to the property in question. 4. That the requested veriance will not be materially detrimenta! to the public welfare or injurious to the prop- erty orimprovements in such vicinity and zone in which the property is loceted. 5. That retzil sales in conjunction with a wholesale es*ablishment in the indust;ial zone, in close proximity to an existing shopping center, is deemed compatible; and, that the petitioner stipulated that retail sales would accourt for only 10% of their regular sales. V 1-G -1. . rs7 :T.:;v a ~ C `- : i ~ ; . ~ ~ } ~ NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission docs hereby grant subject ; Petition for Variance, upon the following conditions which are hereby found to be a necessary prerequisite [o the pro- posed use of the subject property in order to preserve the safety and general welfare of the Citizens of the City of Anaheim. , 1. That trash storage areas shall be provided in accordance with approved plans on file i with the office of the Direct~r of Public Works~ ~ 2. That fire hydrants shall be installed as required and determined to be necessary ;; by the Chief of the Fire Department. 3. That any air-condi.tioning facilities proposed shall be properly shielded from view. 4. That Condition Nos. 1, 2, and 3, above mentioned, shall be complied with prior to the time that the Buil.ding Permit is issued or ~~~ithin a period of 180 days from date ~ hereof, whichever occurs first, or such further time as the Commission or Ciry Council may grant. 5. That subject property shall be develop?d substantially in accordance with plans and specifications on file with the City of Anaheim, ma.rked Exhibit Nos. 1, 2, 3, and 4.
