UsePermitfrom WALT DISNEY PRODUCTIONS, 500 South Buena Vista Street, Burbank, California 91503, Owner; WRATHER FiOTELS, INCORPORATED, 270 Canon Drive, Beverly Hills, Califoi•nia 90210, Agent of certain real property situated in the City of Anaheim, Countyof Orange, State of California, ~ described as the East half of the Southeast quarter of the Ivortheast F Township 4 South, Range 10 West of S.B.B, 8 M. Beginning at the North~esteco~nereof1the2S outh- east quarter of the Northeast quarter of Section Twenty-one, Township Four South, Range Ten West, S.B.B.BM., running thence Southerly alonq the Quarter Quarter Section line 344.06 feet; thence Easterly at a right angle 660.86 raet; thence ~dortherly and parallel with the East Line of said Quarter Quarter Section 344.06 feet to a point in the North line of said Quarter Quarter Section; thence Westerly along the Qua*ter Quarter Section line, 660.88 feet i:o the point of beginning. EXCEPTING therefrom the following: Beginning at the Northwest corner of the North- west quarter of the S outheast qua*ter of the ~dortheast quarter of Section 7'wenty-One, Totia~nship Four South, Range Ten West, S.B.H.BM., and running thence Southerly 344.06 feet to a point; thence Easterly 647.70 feet to a point; thence Northerly 344.06 feet to a ~oint; thence Westerly 647.70 feet to the point of beginning. ; and WHEREAS, the City Planning Commission did hold e public heering at the City Hall in the City of Ana}~eim on July 28, 1969. et 2:00 o'clock P.M., notice of said public hearing having been duly given as required by law end in accordence with the provisions of the Anaheim Municipal code, Chapter 18.64, to hear and consider evidence for and agair.st said proposed canditional use and to investigate end make findings and recommendations in connection therewith; end WHEREAS, said Commission, after due inspection, investigation, and study made by itself ond in its behalf, and efter due consideration of all evidence and reports oftered at said hearing, does find and determine the following facts: 1. That the proposed use is properly one for which a Conditionel Use Permit is authorized by this Code Section 18.64.020(3-j-6) to wit: utilize an approximate 30,000 square foot area along the westerly boundary of subject property for outdoor banquet facilities. 2. That the proposed use will not adversely affect the adjoining land uses end the growth and development of the erea in which it is proposed to be loceted. 3. That the size and shape of the site proposed for the use is adequate to allow the full development of the proposed use in e manner not detrimen:al to the particuler area nor to the peace, health, safety, and general welface o[ the Citizms af the City of Anaheim. 4. That the granting ot the Conditionfll Use Pecmit under the conditions imposed, i( any, will not be detrimental to the peace, healfh, safety, and general welfere of the Citizens of the City of Meheim. 5. That the petitioner stipulated to hours of operation of 6:30 p.m. to 1:00 a.m. 6. That although complaints had been received by the City regarding the excessive noises created by the first "luau", since then the petitioner stated they had removed two of the loud speakers and relocated the remaining speaker, and installed a landscaped berm and thatched frames approximately 10 feet high to reduce any noises. As a consequence, no additional complaints had been received from the residents regarding excessive noises even though these events were held on subsequent weekends. ~. That the peti.tioner indicated that the proposed use will be temporary at this location, and that he would stipulate to a maximum of two yzars for the use on subject property. Cl-G -1- _....., NOW, THEREFORE, BE IT RESOLVED thet the Anaheim City Pl+nnin~ Commission does hereby grant subJecE Pedtlon for Conditionel Use Permit, upon the following conditions which are hete'ry foand to be e necessary prerequisite to the propoaed use of the subject property in order to preserve the sefety ond Qeneral we:fare of the Citlzens of the CIty of AneheIm: 1. That subject property shall be developed substantially in accordance with plans and specifications on file with •che City of Anaheim, marked Exhibit No. 1. 2. That a11 sound baffling as presently existing on the facility shall be retained and maintained in order to protect the single family homes located to the !•~est from the noise effects emanating from subject prooerty. 3. That the hours of operation shall not extend beyond 1:00 a.m. 4. That a time limiatation of one year shall be granted for the use of subject property, subject to an additional year being granted upon request by the petitioner after investigation and approval by the Planning Commission, as stipulated to by the petitioner. ei .
