PC 69-165RESOLUTION NO, Pch9-i6F A RESOLUTION OF THE CITY PLANNING C~MMISSION OF THE CITY OF ANAHEIM THAT PETITION FOR VARIANCE N0. 2108 gg GRANTED WHEREAS, the City Council of the City of Anaheim did initiate a verified Petition for Variance on certain real property situated in the City of Anaheim, County of Orange, State of California, described as that porticn of the land shown as "Navarro Tract" on a map show•~ ing the partition of the M. Yorba Estate, as sho~m on a Map fileri in Boa;c 1, page 27 of Record of Surveys in the office of the County Recorder of said County. Beginning at the Northwest corner of the land described in the deed to Glen Wiley and VJife recorded May 5, 1950 in Book 2008, page 566 of Official Records, records of said County; thence South 0° 27' 00" East, along the Westerly line of said iand, 218~09 feet to the Northe:ly line of La Paima Avenue (106.00 feet wide) as described in the deed to the County of Orange recorded June 29, 1967 in Book 8296, pa9e 113 0.' Official Records, records of said Caunty; thence North 89° 59' 10" East, along said Northeriy line, 717.12 feet to the Easterly line of the land ~escribed in said deed to Glen Wiley; thence North 0° 29' 55" West along said Easter.ly line, 97~57 feet to the Northeast corner of the iand described in said deed to Glen Wiley; thence alony the Northerly line of said land of Glen Wiley, the followinq courses: North 76° 28` 56" West, 30,55 feet; No:tti 769 29' 49" West, 52.24 feet and North 80~ 59' 49'~ West, 645.14 feet to the point of beginning. Harold GFaham Box 425 Bi.g Bear Lake, Calif. 92315 WHEREAS, the City Planning Commission did hold a public hearing et the City Hell in the City of Aneheim on July 28, 1969, et 2:00 o'clock P.M., notice of seid public hearing heving been duly given es required by law e~d in ecrnrdence with the provisions of the Anaheim Municipal Code, Chepter i8.68, to hear and consider evidence for and egainst seid proposed verience end to investigete end make findings and recommendations in connection therewith; and WHEREAS, eaid Commission, efter due inspection, investigetion, end study made by itself and in its behalf, and efter due consideretion of all evidence end reporta oifered at said hearing, does find and detern~ine the following fucts: 1. Thetthe City Council requests a variance frc,~m the Anaheim Municipal Code, as !oiio:cs, to establish an industrial building on subject property: SECTION 18.52.060(2-a-1) Minimum structural setback from a primary hi,ih~mry. (50 feet required; 45 feet proposed). 2. That there are exceptional or extraordinary circumstances or conditions appli::~~Ie to th~ property involved or to the intended use of the property that do not apFly c~enr.ally to the property oz class of use in the same vicinity and zone. 3. That the requested variance is necessary for the preservation and enjoyment of a substantial property right possessed by other pzoperty in the same vicinity and zone, and ,denied to the property in question. 4. That the requested variance wi:l not be materially det:imental to the publi~ v;elfare or injurious to the property or improvements in such vicinity and zone in which the F~roperty is located. 5. That the recent approval of A.D.P. No. 1.U2 required the dedication of the easterly 12' of subject property in order to provide street access to several landlocked parcels to the north, thereby necessitating a change in the location of a buil.ding for which a b~ilding permit had already been requested. That trash storage areas shall be provided in accordance with approved plans on file ~ with the office of the Director of Public Works. 2. That fire hydrants shall be installed as required and determined to be necessary by F the Chief of the Fir~ Department. ; 3. That any air-conditioning facili.ties proposed shall be properly shielded irom vie;v. 4. That Condition Nos. 1, 2, and 3, above mentioned, shall be complied ~a~ith prior ta ~ final 5uilding and zoning inspections. ` 5.
