PC69~171 A RESOLU'fION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM THAT PETITION FOR VARIANCE N0. 2109 BE GRANTED WHEREAS, the Clty Planning Commission of the City of Anahelm did receive e verified Petition for Veriance from STANDARD OIL COMPANY OF CALIFORNIA, 605 West Olympic Boulevard, Los Angeles, California 90015, Owner; ATLANTIC ENGINEERING, INC., 2275 West Lincoln Avenue, Anaheim, California 92801, Agent of certain real property situated in the City of Anaheim, County of Orange, S tate of California, described as being a portion of Lot 2G, Block K, of the Kraemer Tract, as shown on a map recorded in Book 12, page 87 and 86 of Miscellaneous Records o; Los Angeles County. Beginning at a point distant North 74o O1' 47" ~ast 72.40 feet and South 15° 58' 13" Ea~t 53 feet from the fdorthwest corner of that certain parcel of land conveyed to the Northroaa Realty Corporation, a corporation, by executor's deed recorded June 20, 1944 in Book 126~, page 78 of OfficialRecords; thence North 74~ Oi' 47" East parallel with the Northerly line of said land 133.50 feet to a point on a curve concave Easterly and having a radius of 2,421.93 feet, a radial line bears South 69° 13~ 52" West; thence Southerly along said curve through a ~entral angle of 3° 33' 05" an arc distance of 150.12 f'eet; thence South 74° O1` 47" West parallel with said Northerly line 151~51 feet to a point on a curve concave Easterly and having a radius of 2,571.43 reet, a radia]. line bears South 66° 10' 12" West; thence Northerly along said curve through a central angle of 2° 57° 48", an arc distance of 133.02 feet; thence tJorth 26° 42' O1" East 23.02 feet to the point of beginning. ~ . ; and WHEREAS, the City Planning (:ommission did hold a public hearing at the City Hall ir. the City of Anaheim on August 11~ 1959~ at 2:00 o'clock P.M., notice of said public hearing heving been duly given as required ~;' bY law and in accordance with the provisions of the Meheim Municipal Code, ChepEer 18.68, to hear end consider evi- r ; dence for and ageinst said proposed verience and to investigete and meke findings and recommendations in connection _ _x therewith; and °, WHEREAS, said Commission, after due inspection, investigetion, end study mede by itself end in its behalf, end after due consideration of all evidence and reports offered et seid hearing, does find end determine the follo wing facts: 1. That the petitioner requests a varience from the Maheim Manicipal Code as follows, to expand an exi~ting service station structure: SECTION 18.52.060(2-•a-1) - Minimum front setback from an arterial hiqhwav. (,~ (50 feet required; 38 feet proposed). 2, Thet there are exceptionei or eztraordinary circumstances or conditions appliceble to the Froperty invGlved or to the intatded use of the pmpecty thet do not upply generally to the property or class of use in the same vicinity end zone. + 3. Thet the requested varience is necessery for the preservation and enjoymenl of e substential property right ~ possessed by other property in the same vicinity and zone, end denied to the property in question. 4. Thet the requested veriance will not be materially detrimental to the public welfare or injurious to the prop- erty or improvements in such vlcinity and zone in which the property is loceted. ~ 5. That the petitioner stipulated to providing a 3~ foot wide planter area bet~~veen i the access drives on the Kraemer Boule:ard frontage, and since the required planter area ; cannot be provided along the La Pa1ma Avenue frontage the petitioner also stipulated to ~ providing a 3-faot w~ide plantex along the easterly property line, said planter to be at ~ least simiiar in size and dimension to what would be required under normal conditions along ~ the La Palma Avenue frontage. I -1- -- ~a. ~ r 4 _ . _ ' ~ __ _ _ _ f ~ . ~ . {;; _ : ; NOW, THEREFORE, BE IT RESOLVED thet the Anaheim City Planning Commission does hereby grant subject Petition for Variance, upon the following conditions which are hereby found to be a necessary prerequisite to the pro- posed use of the subject propecty in order to preserve the safety and general welfare of the Citizens of the City of Anaheim. 1. That street lighting facilities along Kraemer Boulevard, shall be installed as required by the Director of Public Utilities and in accordance with standard plans and specifications on file in the office of the Director of Public Utilities; and that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installation of the above mentioned requirement. 2. That trash storage areas shall be prqvided in accordance vaith approved plans on file with the office of the Director of Public Works. 3. That subject property shall be landscaped in accordance with the provisions out~- lined in the Service Station Minimum Site Development Standards; provided that in lieu of the required planter strip adjacent to La Palma Avenue, an equal area of landscaping shall be ir:stalled elsewhere on the site. 4. That Condition ~os. 1, 2, and 3, above mentioned, shal: be complied with prior to final building and zoning inspections. 5. That subject property shall be develop?d substantially in accordance with olans and specifications on file with the City of Anaheim, marked Exhibit Nos. 1 and 2.
