A RESOLUTION OF THE ~ITY PLANNING COMMiSSION OF THE CITY OF ANAHEIM THAT PETITION FOR VARIANCE N0. 2110 BE GRANTED WHEREAS, the C;!v Plenning Commission of the City of Aneheim did receive e verified Petition for Veriance from JOAN BELISLE, 1218 Vdestmont, Anaheim, California 92801, Owner; JOHN F. SWINT, 707 West North Street, Anaheim, California 92805, Agent of certain real property situated in the City of Anaheim, County of Orange, State of California, described as that portion of the Northeast quarter of the Northeast quarter of Section 27, Township 4 Spiith, Range 10 West, in the Rancho i~, San Juan Cajon de Santa Ana, as shown on a map recorded in book 51, page 10, Miscellaneous Maps, ;';r,~, records of said ~range County. That the petitioner requests a variance from the Maheim Municipel Code: Section 18.37.020, Permitteo !,i, uses in the C-R, Zone, to establish an auto rental agency as a primary use with waiver of: S ECTION 18.37.040(B-4) - Loration of a free-standino siqn. Thet there ere exceptionel or extreordinary circumstances or conditions epplicsble to the property involved or to the intended use of the property that do not apply generally to the property or cless of use in the seme vicinity and zone. 3. That the requested variance is necessary for the preservation and enjoyment oE a substential property right possessed by other property in the seme vicinity and zone, and denied to the property in question. 4. Thet the requested veriance will not be materielly detrimen:al to the public welfere or injurious to the prop- erty or improvements in such vicinity end zone in which the property is loceted. Vl-G -1- f ~ c~ - r :k 1' 1 NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby grant subject Petition for Variance, upon the following conditions which are hereby found to be a necessary prerequisite to the pro- 4 posed use of the subject property in order to preserve the safet and y generel welfare of the Citizens of the City of ~ Anaheim. 1. That the owner of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot along Katella Avenue, for street lighting purposes. 2. That the owner of subject property shall pay to the City of Anaheim the sum of 15¢ per front foot along Katella Avenue, for tree planting purposes. 3. That trash storage areas shall be provided in accordance with approved plar~s on file with the office of the Director of Public Works. 4. That ar,y air-conditioning facilities proposed shall be properly shielded from view. 5. That Condition Nos. 1 and 2, above mentioned, shall be complied with within a period ~_ of 180 days f*om date hereof or prior to the time that the Building Pexmit is i.ssued, which- ~~ ever occur~ first, or such further time as the Commission or City Council may yrant. ; 6. That Condit.ion Nos. 3 and 4, above inentioned, shall be complied with prior to final ~ buildir.g 2nd zoning inspections. k ~. That subject property shall be deveioped substantially in accordance ~r~ith plans and -,'R~ specifir..~~.ions on file with the City of Anaheim, marked Exhibit No. 1. ~~ 8.
