PC 69-194~ RESOLUTION NO PC69-194 A RESOLUTION OI' THE CITY PLANNING COM2I2SION OF THE CITY OF ANAHEIM THAT PETITION FOR VARIANCE N0. 1 4 BE GRANTCD WHEREAS, the City Plenning Commission of the C3ty of Aneheim did receive a verified Petition for Variance from DAVID SKELLY, 521 West Hermosa Drive, Fullerton, California 92632, Owner; PAUL E. ANTONUCCI, 639 Reseda Street, Anaheim, California 92806, Agent of certain property situated in the City of Anaheim, County of Orange, State of California, described as Lot 1 in Block 4 of Tract No. 304, ~+lills Park Tract, as shown on a map thereof recorded in Book 14, Page 50 Miscellaneous Maps, records of said OTange County. ; end WHE.,q~;A5,, thc City Plenning Commission did hold a public hearing at the City Hall in the City of Anaheim on Seotembes _2~ 1969~ at 2:00 o'clock P.M., notice of said pablic hearing heving been duly given as required by law end in eccordance with the pmvisions of the Meheim Municipal Code, Chap4er 18.68,to hear and consider evi- dence for and ageinst stid pmposed variance end to investigate end meke findings and recommendations in connection therewith; end WHEREAS, said Comm?ssion, after due inspection, investigetion, end study mede by itself end in its behalf, and efter due consideration of all evidence and reports offered at seid hearing, does tind and determine the followi<<g fects: 1. Thet the petitioner requests a veriance from the Anaheim Municipel Code as follows, to permit the establishment of an automotive radi.ator shop in the C-2, General Commercial, Zones a. SECTION 18.44.010 - Permitted uses in the C-2 Zone. b. S ECTION 18.40.070(4-a-2-d and f) - Reauireo number of off-street parkin4 stalls. (13 required; 8 proposed). 2. That there are exceptionel ot extreordinery circumstances or conditions appliceble to the property involved or to the intended use oF the property that do not epply generally to the property or cless of use in the same vicinity and zone. 3, That the requested veriance is necessary for the preservetion and enjoyment of e substentiel property right possessed by other property in the same vicinity end zone, end denied to the property in question. 4. 1'hat the cequested verience will not be meterielly detrimentel to the public welfere or injurious to the prop- erty or improvements in such vicinity and mne in which the property is loceted. 5. That other similar uses have been approved in this area. Vl-G -1- ~ ~ _h ~ ! i -Y NOW, THEREFORE, BE 1T RESOLVED that the Anaheim City Planning Commission does hereby grant subject Petition for Varience, upan the Eollowing conditions which are hereby found to be a necessary prerequisite to the pro- posed use of the subject property in order ta preserve the safety and general welfare of the Citizens of the City of Anaheim. 1. I'hat the owner of subject property shall deed to the City of Anaheim a strip of land 10 feet in width from the centerline of the alley for widening purposes. 2. That the owner of subject property shail pay to the C:ty of Anaheim the sum of 15~ per front foot along Anaheim Boulevard and Mills Lane, for tree planting purposes. 3. That trash storage areas shall be provided in accordance with approved plans on file with the office of the Director of Public Works. 4. That any air-conditioning facilities proposed shall be properly shielded from view, and the sound shall be buffered from adjacent residential homes. 5. That the structure shall be brought up to the minimum standards oi the Uniform Building, Plumbing, and Electrical Codes, as adopted by the City of Anaheim. 6. ?hat any parking area lighting shall be lighted with down-lighting a maximum 6-feet in height and shall be directed away from the property line;: to protect the residential integrity of the area. 7. That Condition Nos. 1, 2, 3, 4, 5, and 6, above mentioned, shall be complied with prior to final building and zonir~ #t~spections. 8. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim, marked Exhibit No. 1.
