Thet the petitioner requests e varience fcom the Anaheim Municipel Code as follows, to cons truct a free-stancJing sign: SECTION 18.37.040(B-2) - Maximum heiaht of a free-stand~nq siqn within 300 feet of residential uses. (25 fr_et permitted; 36 feet prooosed). 2. That there are no exceptianal or.e~ctraordinary circumstances or conditions applicable to the property involved or to the intendea use of the property that do not apply generally to the property or class of use in the same vicinity and zone. 3. That the requested variance is not necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone, and denied to the property in question. 4. That no hardship had been demonstrated that the existing sign was not adequate to properly advertise the use on subj?ct propErty. 5. That colored slides ta!cen of subject property and displayed at the public hearing revealed that the existing sign at the height required by Code more than adequately provided signing of the property from either direction, and any increase in the height would in effect hide th? sign from view of the motorists. 6. That although higher sigr~s had been approved in this general area, compliance with the sign height requirements shouid be adhered to in order that the aP;thetics of the : cbmmercial-recreation area does not acquir? the undesirable appearance of recreation areas in ;; other cities. 7. That approval of this reGuest would establish an undesirable precedent for additional sign height waivers in the area. ; ~tx V 1-D -1- ~ . `~ NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Plenning Commission does hereby deny subject Petition for Variance on the besis of the aEorementioned findings.
