A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM
THAT PETITION FOR VARIANCE N0. 2122 gE DENYED
WHEREAS, the City Plenning Commission of the City of Aneheim d~d receive a verified Petition for Varience from
C. WEAVER, 4004 Southern Boulevard, Youngstown, Ohio 44512, Owner; HEATH AND COMPANY, 3225
Lacy Street, Los Angeles, California 90031, and SAMUFL E. HART AND ASSOCIATES, 8417 Beverly
Bouleuard, Los Angeles, California 90048, Agents of certain real ~roperty situated in the
City of Anaheim, Cour,ty of Orange, State of California, described a~ Parcel lc The North
half of the Southwest quarter of the Southeast quarter of Section 27, 3.n'Township 4 South,
Range 10 West, in the Rancho Las Bolsas, as shown on a Map thereof recorded in book 51, page
10, Miscellaneous Maps, records of Orange County. EXCEPT the Westerly 40 feet thereof; A;S 0
EXCEPTING THEREFROM the Southerty 220 feet thereof, measured along the Westerly line of said
North half. Parcel 2: The South 160.00 feet of the Northwest quarter of the Southeast
quarter 9f Section 27, in Township 4 South, Range 10 West, partly in the Rancho Las Bolsas,
and partl.y in the Rancho San Juan Cajon de Santa Ana, as shown on a map thereof recorded in
book 51, page 10, Miscellaneous Maps, records of said Orange County.
WHEREAS, the City Plenning Commisalon did hold e public hearing et the C;ity Hell in the City oE Aneheim on
November 3~ 1969, at Z:00 o'clock P.M., notice of said public hearing heving been duly given es required by
law and in eccordance with the provisions of the Anaheim Municipel Code, Chepter 18.68, to hear and consider evidence for
and egeinst seid proposed vatience end to investigete and meke findings end recommendetions in connection therewith;
end
WHEREAS, eaid Commission, after due inspection, investigetion, end study mede by itselE end in its behelf,
and efter due consi:ieration of all evidence nnd reports oEfered at seid heoring, does find and determine the following
fects:
1. Thet the petitionet requests e verience from the Anehelm Municipel Code as follows~ to establi5h an
outdoor playpround equipment display and sales area in conjunction with an existing
shopping center facility on subject property.
a. SECTION 18.44.010 - Permitted uses in the C-2 Zone.
b. SECTION 18.60.010(c) - P?rmitted uses in the P-L 7one.
c. SECTION 18.62.090(A~ - Aaqrecaate sipn area aer 300 feet of lineal
s~reet frontacae. (600 sauare feet permitted;
768 sauarP feet proposed)
d. SECTION 18.62.090~ - Minimum dista_nce between a roof siqn and a
free-standinq sipn. (300 feet required;
126 feet proposed}
2. That the petitioner has not submitted evidence i:}iat a hardship existed or that he
was being deprived of a privilege afforded other property oxmrrs and denied to him.
3. That the g:anting of subject petition to permit outdoor disp;ay a~~d sales in the
required front setback would be granting a privilege to the petitioner which other
property owners were denied, furthermore, the required setback is for the purpose o;
parking automobiles or landscaping only.
4. That due to the size of subject property there is sufficient area elsewhere, other
than in the setback area, where the use could be located.
5. That approval of subject petition would set an undesirable precedent for similar
req~iests for outdoor display and sales from othel commercial facilitiea where such
uses have been required to confine said operations indoors.
G. That signir,g of subject property can he accompli.ehed within the confines of the
sign ordinance and to grant the proposed signing would be granting a privilege not
afforded to adjoining property owners.

NOW, THEREFORE, BE IT RESOLVED thet the Aneheim City Plenning Coamissio~ does hereby deny subject
Petition for Variance on the besis of the aforementianed findings.
