PC 69-234RESOLUTION N0. pC69-234 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM T4AT PETITION FOR VARIANCE NO. 2138 BE DENIED WHEREAS, the City PlannIng Commission oE the City of Anaheim did receive a verified Petition for Variance from ROBERT M. TI-IOMPSON, 921 South Gilbert Street, Anaheim, California 92804, Ovoner; FOREST E. OLSON, INCORPORATED, 1959 East Lincoln Avenue, Ariaheim, California 92805, Agent of cer:ain real property situated in the City of Anaheim, Cc+unty of Orange, State of California, described as Lot 54 of Tract No. 2468, as per rrap recc.rded in book 85, pages 28 and 29, Miscelianeous Maps, in the office of the County Recorde= of said County. WHEREAS, the City Plonning Commission did hold a public hearing at the City Hell in the Clty of Aneheim on November 17, 1969, et 2:00 o'clock P.M., notice of seid public heering heving been duly ~,iven es requi:ed by lew and !n eccordaace with fhe provislons oE the Aneheim Municipal Code, Chepter 18.68, to hear and consider evidence for and ageinst seid proposed varience end to inveatiQete end meke find}ngs and recommendeFions in connection therewith; and WNEREAS, eald Commissfon, efter due inspection, investigation, end study made by itself end in its behelf, and efter due conside:ation of all evidence nnd reports otfered at seid hearing, does find and detertnine the tollowing fects: 1. Thet the petitioner requeats e verience from the Anaheim Munlcipel Cnde, a5 fOl lOwS, :0 permit the expansion of an existing medical office facilityinto an existing residence on an adjacent R-1 Zoned lot• S ECTION 18.24.010 - Permitted uses in the R-1 Zone. SECTION 18.04.030(b-1) - Minimum reUuired parkinq soaces (5 s~aces required; 2 snaces proposed). 2. That approval of the proposed variance request would in effect be tantamount to approving commercial zoning in this residential area, and such approval would set an un- desirable precedent for add:tional requests for commercio; use of the single-family homes fronting on Gilbert Street, which in turn would have a deleterious effect upon the established residential integrity of this general area. 3. That subject property is within one of the number of areas considered for potential commercial conversion in A Studv of the Probierr of Residential Homes Frontinq on Arterial Hiqhwavs, adopted by both the Planning Commission and City Council in 1967; that said study, as adopted, indicated that the residential homes fronting on the west side of Gilbert Street between Ball Road and Stonybrook Drive should be retained for residentia] uses; and that approval of the proposed request would be contrary tu this policy statement. 4. Tl;at that there are no exceptional or extraordinary circumstances or condit.:ons applicable to the property involved or to the intended use of the prooerty that do not apply generally to the propezty or class of use in the same vicinity and zone. 5. Thdt the requested variance is not necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone, and denied to the oroperty in question. 6.That the requested variance will be materially detrimental to the public welfare and injurious to the property or improvements in such vicinity and zone in which the property is located. %.
