Box 7, Fullerton, California 92632, Agent of certain real property situated in the City o; Anaheim, C~unty of Orange, State of California, described in Exhibit "A" attached }~ereto and referred to herein as though set forth in full ~ , and ~;y i~" WHEREAS, the CIty Plenning Commission did hold e public hearing et the City Hall in the City of kneheim on !F February 10, 19b9, at 2:00 o'clock P.M. notice of seid public hearing heving been duly given es required by ~~ lew and in accordence with the provisions of the Meheim htunicipal Code, Chepter 18.72, to hear and consider evidence for ar.d ageinst said ptoposed reclassiEication end to investigete end make findinga end recommendations in connection therewith; and WHEREAS, seid Commiasion, after due inspection, investigetion, end study made by itself end in its behelf, and efter due conaiderstion of all evidrnce and reports offered at seid heacing, does find end determine the following fects: 1. Thet the petitioner proposes a reclessifica:ion of the above deacriMd prcperty from the R-A, Agricultural, Zone to the R-3, Multiple Family Resideniial, Zone. 2. That although the 1969 Preliminary General Plan projects transititional loiv-medium density uses between the ].oMr-density to the west of subject property and the medium-density to the east, it is felt that due to the size of the parcel, it would be extreme_y difficult to develop for low-me~ium density land use, in particular R-2-5000, One Family Residential. 3. Thet the proposed reclessiiication of subject property is necessery end/or desirable for thr. orderly and pro- per development of the community. 4. Thet the proposed reclaesificetion of subject p[operty does properly relate to the zones and their permitted uses locelly esteblished in close proximity to subject property and to the zones and their pecmitted uses gene:elly estab- liehed throughout the community. 5. That the proposed reclassification of subject property requires the dedication an~ improvement of abutting streets in accordance with the Circulation Elem ent of the General Plan, due to the anticipated increase in traffic which will be generated by tha intensification of land use. 6. That one person appeared in opposition expressing concern that extending Del Monte Drive thru the R~-1 development to the west will create a traffic hazard to the children of the area, and that drainage will be inadequate to take care of the additional drainage from the proposed development. T!~at the owner of subject propPrty shall deed to the City of Anaheirr a strip of land 32 Feet in width from the centerlire of the street along Grand Avenue, and a strip of land 64 f eet in width as shown on the development plans for the extension of Del Monte Drive. 2. That street improvement plans shall be prepared and all engineering requixements of the Ci•ty of Anaheim along Grand Avenue, Del M~nte Drive and Lincoln Avenue, such as curbs and gutters, sidewalks, st:eet grading and paving, drainage facilities, or other appurten3nt work shall be completed as required by the City Engineer and in accordance with standard plans and specifications on file in the office of the City Engineer; and that a bond in an amount and f~rm satisfactory to the City cf Anaheim shall be posted with the City to guarantee the in- stallation of said engineering r.equirements. 3. That the owner of subject property shall pay to the City of Anaheim the sum of $2,00 p~• front foot along C~rand Avenue, Del Monte Drive and Lincoln Avenue, for street lighting purposes. 4, That the owner of subject property shall pay to the City of Anaheim the sum of 15~ per front foot along G*and Avenue, D~1 Monte Drive and Lincoln Avenue, for tree planting purposes. 5a That the owner of subject propert°~ shall acquire rights of access to the alley east of subject property across Lots "B" and "C" of Tract Noo 4230. 6~ That Condition Nos. 1, 2, 3, 4, and 5, above mentioned, shall be complied with within a period of 180 days from the date hereof, or such further time as the City Council may grar.t. 7. That the owner o:` subject property shall pay to the City of Anaheim park and recreation fees for each dweliing unit, as required by C~.ty Council resolution, which shall be used for park and recreation purposes, said amount to be paid at the time the Building Permit is issued~ 8. That ordinances reclassifying the property shall be adopted as each parcel is ready to comply with conditions pertaining to such parcel; provided, however, that the word "parcel" shall mean presently existing parcels of record and any parcel or parcels approved by the City Council for a lot split.
