A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CiTY OF ANAHEIM
THAT PETITION FOR VARIANCE NO. 2141 gE GRANTED
WHEREAS, the City Plenning Commiesion of the City of Aneheim did receive e verified Petition for Verience
feom FRANK MULLER, R.C.A. BUILDING, SUTTE 700, 6363 Sunset Boulevard, Hollywood, California
90028, Owner; JAMES ELKINS, LEXINGTON DEVELOPMENT CORPORqTION, 600 West La Veta, Orange,
California 92668, Agent of certain real property situated in the City o: Anaheim, County of
Orange, State of California, described as the Westerly 468.01 feet of that poriion of the
Southeast quarter of Section 8, Township 4 South, Range 10 West in the Rancho Los Coyotes,
shown as Parcel 1 on a map filed in Bcok 10, page 35 of Parcel Maps in the office of the
County Recorder of said County.

WHEREAS, the City Planning Commission did hold e public heering et the City Hsll in the City of Ane,Seim
on DeCember 1, 1969 et 2:00 o'clock P.M., notice of said public hearing having been duly given es requited
' by law aad in eccordence with the provisions of the Anaiteim Municipel Code, Chepter 18.68, to hear end consider evi-
;' dence for ~td egainst seid proposed variance and to investigate and make findings and recommendetions in connection
- therewith; end
WHEREAS, said Commission, after due inspection, investigation, end study mede by itself and in its behalf,
nnd efter due consideration of ali evidence and reports offered at seid hearing, does find end detennine the following
facts:
1. Thet the petitioner requests a vanance from the Aneheim Municipal Code as follows, to establ ish
;' an 86-unit, tv~o-story apartment complex:

2. That the above mentioned waiver is hereby granted on the basis that the waivers
are applicable only to pedestrian accessways and areas separating apartment units and car-
~f ports and similar waivers have been granted on numerous occasions.
~ 3• Thet there are exceptionel or extwordinary circumstences or conditions appliceble to the propecty involved
1, or to the intended use of the propecty that do not epply generally t~ the property or class of use in the same vicinity and
zone.
4. Thet the requested vac.ance is necessery for the presen•ation end enjoymmt of a substential property right
possessed by other Ftoperty in the seme vicinity and zone, and denied to the property in question.
