PC 69-254RESOLUTION N0, PC69-254 A RESOT.UTION OF THE CITY PLANNING COMMISSIOiV OF THE CITY OF ANAHEIM RECOMMENDING TO THE CITY COUNCIL OF THE CTTY OF ANAHEIM THE ESTAiiLISHMENT OF A POLICY WHICH jdILL PERMIT THE SAI,E OF MOBILE HOMES AT RECENTLY APpROVED MOBILE HOME PARKS WITHIN THE CITY THERETO WHLREAS, the City Council and the Development Services Department have recei.ved complaints from the Mobile Home Association and certain mobile home dealers relative to sales of mobile homes in a new mobile home park located at the southwest corner of Gilbert Street and Crescent Avenue: and WAEREAS, the Mobile Home Association questions the legali[y of this operatior~ since they feel the property is not properly zoned for such sales, namely Commercial Zoning; and - WHEREAS, L•he sale of mobile homes, per se, is not permitted by right ur by conditional use permit in any specific zone within the City of Anaheim, therefore, the sale of these vehicles would, according to the City Attorney's office, require the approval o£ a variance or by property being reclassified to the C-3, Heavy Commer- cial, Zone, which is deemed the most appropriate zone for such a use; and WHEREAS, several trailer manufacturers in surrounding cities contend there are "closed sale" features involved which precluded participation in the sale of mobile homes to all but the specific mobile home models exhibited by L-lie manuf.acturer(s); and WHEREAS, the City Attorney and Development Services Department are of tlie opinion that mobile home sales, limited to use of said mobile homes on recentiy approved mobile home park sites, do not constitute "commercial sales" within thz limi[ation of Commer- cial Zoning, but are for the accormnodation of the park tenants and control by the park management; and WHEREAS, :he appropriateness of such mobile home sales is a matter of policy rather than law, and as such must be determined by the Planning Commission and the City Council, NOW, THEREFORE, BE IT RESOLVED that the City Planning Cormnission reco~mnends and it does hereby recommend to the City Council of the City of Anaheim the adoption of a policy which will permit the sale of new mobile homes for use in newly established and approved mobile home parka, which sales shall be restricted to mobile homes solely for placement in said newly established and approved mobile Iiome parks; and that the sale af such mobile homes shall cease when all spaces within said park are filled, except that replacement sales may be made whenever a vacant space occurs.
