A RESOLUTION OF THE CITY PLANNING COAfMISSION OF THE CITY OF ANAHEIM
THAT PETITION FOR VARIANCE NO. 21a3 gE GRANTED
WHEREAS, the City Planning Commission of the City of Aneheim did receive a verified petition for Varience
from ALBERT S. TOUSSAU, 6672 Richfield Road, Anaheim, California °2806,~ner;P.;~LLO D~VFLOPMENT
CORPORATION, 1104 Eas± 17th Street, Santa Ana, California 92701, Agent of certain re21 property
situated in the City of Anaheim, County of Orange, Siate of California, described as Portion "B":
That portion of the Nor~heast quarter of the Northwest quarter of the Northwest quarter of
Section 24, Township 4 South, Range 10 PJes{:, in the Rancho San Juan CajonDeSantaAna, assnorm on a
Map thereof recorded in Book 51, Page 10 of Miscellaneous Maps, records of said County, lying
Easterly of the following described line: Beginnino at a point in the Northerly line of said
Northeast quarter, distant Easterly thereon 343.00 feet from the Northwest corner of said North-
east quarter; thence Southerly parallel with the VJesterly line of the Northeast quarter of the

i WHEREAS, the City Plenning Commission did hold a public hearing at the City Hall in the City of Anaheim
~ onDecember 29, 1969 at 2:00 o'clock P.M., notice of seid public hearing having been duly ;;iven as required
!' by law and in accordance with the pro ~isions of the Maheim Municipal Code, Chapter 18,68, to hear imd consider evi-
- ~ dence for and ageinst said proposed varience and to investigate and meke findings and recommendationc in connection
- therewith; and

WHEREAS, seid Commission, aEter due inspection, investigation, and study made by itself a:id in its behalf,
and after due rnnsideration of all evidence and reports offered at said hearing, does find and detennine the follo wing
facts:
1. Thet thr. petitioner requeats a vorience from the Anaheim Municipel Code as fol lows, to es tabl is h a
2<0-unit apartmen~ complex on subject property:
1) SECTION 18.28.020(1) - Maximum permitted number of main buildinqs oer site.
(2 main buildings permitted; 21 main buildings pronosed).
2) SECTION 18.28.050(7-a) - Minimum distance between buildinqs. (14 feet re-
quired; 8 to 12 feet proposed).

3. That the requested varience is necessary for the preservation and enjoyment of a substantial property right
~.` - possessed by other property in the seme vicinity and zone, and denied to the property in question.
g. 4. That the requested verionce will not be meterielly detrimentel to the public welEare or injurious to lhe prop-
~- erty or improvements in such vicinity end zone in which the property is located.
~,~ 5. That the waivers from the site development standards of the Anaheim Municipal Code
'~` requested by the petitioner have been granted to other multiple family develoi~ment projects
;., throughout the City, therefore, the granting of these svaivers would not be granting a privilege
,y not enjoyed by other properties in the same zone.

NOW, THCREFORE, BE IT RI:SOLVEU that the Anaheim City Planning Commission does hereby grant subject
Petition for Variance, upon the followiag conditions which are hereby found to be a necessary prerequisite to the pro_
posed use of the subject property in order to preserve the safety and genewl welfare of the Citizens of the City of
Anaheim.
1. That this variance is granted subject to the completion of Reclassification IJo.
69-70-299 now pending.
2. That subject property shall be developed substantially in accordance with plans
and specifications on file with ±he City of Anaheim, marked Exhibit Nos. 1, 2, 3, q, 5,
and 6.
