A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE (;ITY OF ANAHEIM
THAT PETITION FOR CONDITIONAL, USE PERMIT NO. ~ BE GRANTED
WHEREAS, the City Plenning Commission of the City of Anaheim did receive a verified Petition for Conditional
UsePermitfrom FOREST LAWN CF1v1EfERY AS9JCIATION, P. 0. Pox 1151, Glendale, California 91209,
Owner; LP.DD W. FAULKNER, 210 South State College Boulevard, Anaheim, California 92806, Agent of
certain real property situated in the City of Anaheim, County of Orange, 5tate of i:alifornia,
described in Exhibit "A" attached hereto and referred to herein as though set forth in full.

WHERER:~, the City Planning Commission did hold a public hearing at the City Hall in the City ot Aneheim on
March 10~ 19f-9, at 2:00 o'clock P.M., notice of seid public hearing heving been duly given as required by
lew and in ecavdance with the provisions of the Anaheim Municipal code, Chapter 18.64, to hear and consider evid~nce
for end eqait:st seid proposed conditionel use ond to investigate and meke findings and recommendetions in connection
therewith; and
WHEREAS, said Commission, after due inspection, investigation, and stu~y mode by itself end in its behelf, and
efter due consideratian of ell evidence and reports offered at said hearing, does find end determine the tollowing facts:
1. That the proposed use is properly one for which a Conditional Use Permit is aut!~orized by Code:
Section 18.40.060(g) to wit: establish an existing walk-up restaurant es a conforming
use, and to permit on-sale beer in conjunction with meals ir~ the existing restaurant on
subject property.
2. Thet the proposed use will not edversely effect the adjoining lend uses end the growth end development of
the area in which it is proposed to be located.
3, Thet the size and shape of the site proposed for the use is adequete to ellow the full development of the
Fmposed use in a manner not detrimental to the particuler erea nor to the peace, health, sefety, end general welfare u[
the Citizens oE the City of Anaheim.
4. That the grenting of the Conditional Use Pecmit under the conditions imposed, if any, will not be detrimentel
to the peace, health, sefety, and generel welfare of the Citizens of the City of Anaheim.

NOW, THEREFORE, BE IT RESOLVED thet the Anaheim City Planning Commission does hereby grent subject
Petition Eoe Conditlonel Use Permit, upon the following conditions which are hereby found to be e necessary prerequisIte
to the proposed use oE the subject propedy in order to preserve the sefety end general welfere of the Citizens of the
City of Aneheim:
1. That the owner of subject property shall deed to the City of Anaheim a strip
of land 53 feet in width from the cer.terline of Lincoln Avenue9 for street widening purposes,
within 180 days from date hereof, or such further time as the Commission or City Councii may
grant.
2. That beer shall be served only with meals to seated customers; and that there
shall be no bar facilities nor shall beer be served to customers ordering their food through
walk-u~ windows.
