WILLIAMS, 1626 East Santa Ana, Anaheim, California 92805, Owner; CHARLES DOUGLAS ELLINGTON, 2300 West Manchester Boulevard, Inglewood, Caiifornia 90305, Agent of certair real property situated in the City of Anaheim, County of Orange, State of California, described as beginning at the intersection of the Westerly line of a strip of land 75.00 feet wide, described in a deed to L•he Orange County Flood Control District recorded April ~, 1960 in Book 5185, Page 451 of Offical Records with the ~Jortherly line of Tract No. 5703 as shown on a Map thereof recorded in Book 209, pages 26 and 27 of Miscellaneous Maps, records of said County, thence along sai9 Noxtgerly line North 88°33'00" Wesv 274.80 f eet to an angle point therein, thence continuin alon said Northerly line South 75 12 00' West 27.00 feet to an angle point therein~ thence continuing also said Norther~y line, South 89056'00" West 560,00 feet to the Easterly line of the Atchison, Topeka and Santa Fe Raiiway's 100,00 foot right o: way; thence Northerly along said last mentioned Easterly line to the Northerly line of said Lot 4; thence Easterly along said last mentioned Northerly line to the Westerly line of said strip of land described in de2d to the Orange County Flood Control District; thence Southerly along said Westerly line to the point of beginning. ; and WHEREAS, the City Planning Commission did hold a public heating at the City Hall in the City of Aneheim on March 24~ 1969~ at 2;00 o'clock P.M., notice of said public heering having been duly given as required by law end in accordance with the proviaions of the Anehoim Municipal code, Chepter 18.64, to hear and consider evidence for and agair.st said proposed conditional use and to investigete and make findings and recommendalions in connection therewith; and ~1 ~ WHEREAS, said Commission, aEter due inspection, investiPation, and study made by itself and in its behalf, and efter due consideration of all evidence und reports o[fered at said heating, does find and deteenine the following facts: 1. That the proposed use is properly one for which a Conditional Use Pertnit is authorized by Code: Section 18.64.020(2-d) to wits expand an existing mobile home park with 45 trailer spaces, laundry buildiny and lounge on subject property. 2. Thet the proposed use will not edvetsely effect the odJoining lend uses and the growth and development of the area in which itis proposed to be loceted. 3. Thet the s3ze end shape of the site proposed for the use is adequete to allow the full development of the proposed use in a manner not detrimental to the perticuler erea nor to the peace, health, safety, end generel welfare of the CitIzens of the City of Aneheim. 4. That the granting of the Conditional Use Peanit under the conditions imposed, if any, will not be detrimental to the peace, health, sefety, and eeneral welfare of the Citizms of the City of Aneheim. 5. That the petitioner is advised that, by resolution, the City Council has determir.ed that the following park and recreation fees shall be applicable and payable at the time a building permit is issued: a) Issuar.ce of a building permit prior to May 1, 1969 -$25 per trailer space; or b) Issuance of a building permit subsequent to April 30, 1969 -$50 per trailer space. Cl-G -1. ~ NOW, THEREEURE, BE IT RE50LVED that the Anaheim City Alanning Commission does hereby grant subject Petition for Conditional Use Permit, upon the following conditions which are hereby found to be a necessary prerequisite to the proposed use of the subject property in order to preserve the safety and general welfare of the Citizens of the City of Anaheim. 1. That the owner o. subject property shall dedicate ~o the City of Anaheim a standard 50-foot radius cul-de-sac at the terminus of Kenwood Avenue. 2. That street improvement plans shall be prepared and all engineering requirements of the City of Anaheim along Kenwood Avenue, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or other appurtenant work shall be completed as required by the City Engineer ar.d in accordance with standard plans and specifications on file in the office of the City Engineer; and that a bond in an amount and form satisfactory to the City of Anaheim shall be posted with the City to guarantee the installation uf said engineering r equ ir em ents . 3. That the owner of subject property shall pay to the City of Anaheim the sum of $2,00 per front foot alang Kenwood Avenue, for street lighting purposes. 4. That the owner of subject property shall pay to the City of Anaheim the sum of 15~ per front foot along Kenwood Avenue, for treE planting purposes. 5. That trash storage areas shall be provided in accordance with approved plans on file with the office of the Director of Public Works. 6. That fire hydrants, shail be installed as required and determined to be necessary by the Chief of the Fire Department. 7. That a 6-foot masonry wall shall be constructed along the east, ~aest and south property lines. 8. That any air-conditioning facilities proposed shall be properly shielded from view, and the sound shall be buffered from adjacent residential homes. 9. That Condition Nos. 1, 2, 3, and 4, above mentioned, shall be complied with prior to the t=me that the Suilding Permit is issued or within a period of 180 days from date hereof, whichever occurs first, or such further time as the Commission or City Council may grant. 10 , That Condition Nos. 5, 6, 7, and II, above mentioned, shall be complied with prior to fina.l building and zonina inspections. 11. That the owner of subject property shall pay to the City of Anaheim park and recreation f ees for each trailer space, as required by City Council resolution, which shall be used for park and recreation purposes, said amount to be paid at the time the Building Permit is issued. 12. I'hat the proposed development sha~l be in accordance with requirements of the State Trailer Act, and that plumbing shall be provided in o.rder that the mobile home park, will accommodate all trailers and not be restricted to "California approved trailers" only. 13. I'hat subject property shall be developed suhstantially in accordance wi~h plans and specifications on file with the City of Anaheim, marked Exhibit Nos. 1 and 2.
