A RESOLUTION OF THE CITY PLANNING COMMISSION OF TF~IE CITt' OF ANAHEIM THAT PETITION FOR VARIANCE N0. 2~67 gE APPR~VED WHEREAS, the City P]anning Commission of the ~ity of Anan,-im did receive a verified Petition for Variance from GLEN MARTIN, 638 Peregrine Street.• Anaheim, California 92806, Owner; GEORGE CLARKE AfdD PJAYNE HDWARD, INC., 1116 North Harbor B~~levard, Santa Ana, California 92703, Agent of certain real property situated in the City of nnaheim, County of Orange, State of California, described a~ LOt No. 47 of Troct N0. 1987. ~ ~ .. ; end WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim on April 7, 1969~ at 2:00 o'clock P.M., notice of said public hearin havin been dul lew and in accordence with the provisions of the Anaheim Municipel Code, Chapter 18,68, to hear and cois der evidence or and ageinst said proposed variance and to investigate end meke findings and recommendations in connection therewith; and WHEREAS, seid Commission, after due inspection, investigation, end study mede by itself and in its behalf, and after due consideration of all evidence and reports offered at said hearing, does find and detertnine the following fects: 1. That the petitioner requests a verience from the Anaheim Municipel Code as follows, to permit an addition to an existing resid~ntial structure. (a) SECTION 18.24.030(3-b) - Minimum required rear vard. (10 feet required; 5 f ee+, propos ed ). (b) SECTION 18.24.030(3-b) - Maximum covera4e of required rear yard. (35 coverage permitted; 45. coverage proposed). 2. That there are except~onal or axtraordinary circumstances or conditionc applicable to the property involved or to the intended use of the property that do not apply generally to the property or class of use in the same vicinity and zone. 3. That the requested variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone, and denied to the property in question. 4. That the requested variance will not be materially detrimental to the public welfare or injurious to the property o- improvements in such vicinity and zone in which the property i~ located. I'hat the addition structure shall be constructed to the minimum standards of the ~ Uniform Building, Plumbing and Electrical Codes, adopted by the City of Anaheim and shall be `i complied with prior to final building and zoning inspections. 2.
