WHERE:AS, th2 City Planning Commission of the City of Aneheim did receive a verified Petition for Verionce from
LEWIS R. AND JUDITH E. SCh,'MID, 2940 "A" Randolph, Costa Me:>a, California 92620, Owners of certain
real property situated in the City of Anahiem, County of Orange, State u: California, described
as Lot 1 of Tract No. 6646, as shown on a map thereof recorded in Book 249, Pa9es 38 ar.d 39 of
h+;scellaneous Maps, in the office of the County Recorder of said Orange County.

WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim on

l~r,• y~d ~,n acaordance with the ptovisions of the Anaheim Municipel Code, Chapter 18.68, to hear and cons der evidence or
and egein~t 3aid proposed veriance and to investigate and make findings and recommendetions in connec;ion therewith;
and
WHEREAS, seid Commission, after due inspection, investigation, end study mede by itself end in its behalf,
and efter due consideration of all evidence and reports offered at seid hearing, does find and detertnine the foltowing
fects:
1. That the petitianer requests a varience from the Ananelm Municipel Code as follows, to permit the
establishment of a 109-unit, one and two-story apartment complex on sub;ict property:
(a) SECTION 18.28,050(6-a-4) - Buildinq setback rrorr local street. (15 feet required;

2. That there are exceptional or ex.traoroinary circumstances or conditions aoplicable
to the property involved or to the intended use of the property that do not apply generally to
the property or class of use in the same vicinity and zone.
3. That the requested variance is necessary for the preservation and enjoyment of a
substantial property right possessed by other property in the same vicinity and zone, and denied
to the property in question.
4. That the.requested variance will not be rnaterially detrimental to the public weifare
or injurious to the property or improvements in such vicinity and zone in which the property is
located.
5. That the petitioner stipulated that any window; alon; the 8-foot corridor separation
betaieen buildings irould be off-set at 3 SUf:1C1~-nt angle so thal a minimum angular distance of
15 feet will separate op;osing dwelling unit ,vindows.

the safety and general welfare of the (:itizens o: the City ot Anaheim~
1. That street improvement plans shaJ.l be prepared and all engineering *equirem~nts o:
the City of Anaheim along Almont Avenue, such as curbs and gutters, si.7e•nal~'s, street graoiny
and paving, drainage facilities, or other appurtenant work sha11 Ge :ompleted as required by
the City Engineer and in accordance with standard plans and specific~ 'ons on fi!e in the
office of the City Engineer; and that a bond in an amount and form sacisiactory to *_he City of
Anaheim shall be posted with the City to guarantee the installation of said ~nginePring re-
quir ements .
2. That the owners of subject property shali pay to the City of Anaheirn the sum of $2.00
p°= front foot along Almont Avenue, for street lighting purposes.
3. That a Parcei Map to record the apFroved division of subject property be submitt~d to
the Cit;~ of Anaheim for aoproval and then be recordeci ;n tY.e of:ice of the Orange County
Recorder.

5. That fira hydrants shall be installed as required and determined to be necessary by
the Chief of the Fire Department.
6. Tt,at any air-conditioning facilities propose~ ~hal.l be properly shielded from vien~,
and the sound shall be bufiered from adjacent reeidential homes,
~. That any parking area lighting shall be iight?d with down-lighting a maximum 6-feet
in height and shall be directed away from the p,r~;~rty lines to protect the residential
integrity of the area.
8. That the owners of subject property shall install irrigation facilities for the park-
way trees on the north side of Almont Avenue as required by the Parkway Maintenance Superinten-
dent.
9. That Cor,dition Nos. 1 and 2, above mentioned, shall be complied with ~rior to the time
that the Suildin, Permit is issued or within a perio:l of 1t~0 ~lay~ `roni date hereof, which?v?r
occurs first, ur such :urther time as the Commission or City Council may grant.
10. That C~fndition Nos. 3, 4, g, 6, 7, and 8, nbove mentioned, shali be complied w?t~~ prior
to final huilainq ar.d zoning inspections.
11. That the owners of subject property shall pay to the City of Anaheim park ar,d :EC;rea-
tion fees for each dH~elling unit, as required by City Council resolution, which shall b~, u;ed
f'or park and recreation purposes, said amount to be paid at the t?me the Building Permit is
issued,
12. That subject propezty shall be dev?lope~ substar,tially in accordance with plans and
specifications on file with the City of Anaheim, marked Exhibit Nos. 1, 2, 3, 4, 5, b, 7, and
~: provided, hov,~ever, that v,indo~ns proposed along the 8-foot ~~:ide ~orridors between buiidings
shali be off-set at a sufficient angle so as to provide a minimum angular separation of 15
f?et between w~inda.vs on either side of these structurr_-s, as stipulated to by the netitioner.
