SCh,'MID, 2940 "A" Randolph, Costa Me:>a, California 92620, Owners of certain real property situated in the City of Anahiem, County of Orange, State u: California, described as Lot 1 of Tract No. 6646, as shown on a map thereof recorded in Book 249, Pa9es 38 ar.d 39 of h+;scellaneous Maps, in the office of the County Recorder of said Orange County. 1 ; and WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim on ApTil 7, 1S~9~ • et 2:00 o'clock P.M., notice of said public hearin havin been dul l~r,• y~d ~,n acaordance with the ptovisions of the Anaheim Municipel Code, Chapter 18.68, to hear and cons der evidence or and egein~t 3aid proposed veriance and to investigate and make findings and recommendetions in connec;ion therewith; and WHEREAS, seid Commission, after due inspection, investigation, end study mede by itself end in its behalf, and efter due consideration of all evidence and reports offered at seid hearing, does find and detertnine the foltowing fects: 1. That the petitianer requests a varience from the Ananelm Municipel Code as follows, to permit the establishment of a 109-unit, one and two-story apartment complex on sub;ict property: (a) SECTION 18.28,050(6-a-4) - Buildinq setback rrorr local street. That the requested variance is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone, and denied to the property in question. 4. That the.requested variance will not be rnaterially detrimental to the public weifare or injurious to the property or improvements in such vicinity and zone in which the property is located. 5. That street improvement plans shaJ.l be prepared and all engineering *equirem~nts o: the City of Anaheim along Almont Avenue, such as curbs and gutters, si.7e•nal~'s, street graoiny and paving, drainage facilities, or other appurtenant work sha11 Ge :ompleted as required by the City Engineer and in accordance with standard plans and specific~ 'ons on fi!e in the office of the City Engineer; and that a bond in an amount and form sacisiactory to *_he City of Anaheim shall be posted with the City to guarantee the installation of said ~nginePring re- quir ements . 2. That any parking area lighting shall be iight?d with down-lighting a maximum 6-feet in height and shall be directed away from the p,r~;~rty lines to protect the residential integrity of the area. 8. That the owners of subject property shall install irrigation facilities for the park- way trees on the north side of Almont Avenue as required by the Parkway Maintenance Superinten- dent. 9.
