PART { ': WHEREAS, ~ , the City Planning Commession of the City of Anaheim did receive a verificd Petition for Variance from STATER BROTHERS MARKET, 21700 Barton Road, Colton, California 92324, and MAY~R OONSTRUCIION ~ COMPANY, 802 East 2~d Street, Downey, California 90241, ~Owners; •JOHN R. SCHAtJI'Z, 1741 West Katella Avenue, Anaheim, California 92804, Agent of certain real property situated in the City of Anaheim, County of Orange, State of California, described in Exhibit "A" attached hereto and referred to h=rein as though set forth in full ,~ ;- I : ; end ~ ; WHEREAS, the City planning Commission did hold a public hearing at the City Hall in the City of Aneheim on •~? January 13, 1969, at 4:00 o'clock P.M., notice of said public hearing heving becn duly given as required by lew and in accocdance K~ththe provisions of the Anaheim Municipel Code, Chepter 18.68, to hear and r,onsider evidence for and against said proposed variance and to investigate and meke findings and recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation, and study mede by itself and in its behalf, and afta due cnnsideretion of ell evidence end reports otfered at said hearing, does find and determine the following fects; 1. That the petitioner requests e veriance from the Anaheim Municipal Code as follows~ to ermit the establishment of an outdoor garden supply, lumber= and fencing sales area in conjunction with a home improvement center: SECTION 18 40 040 - Permittad outdoor ,~s s C 1 Zon . That the requested waiver of the maximum area of a free-standing sign is hereby denied on the basis that subject property could be signed adequately within the requirements of tho zone, that no hardship had been proven~ and that excessi~:e signing could establi:sh an undesirable precedent for adjoining commercial uses. 3. That the proposed outdoor use is determined not to be detrimental to the area, due to the manner in which the use is to be screened. 4. That the proposed 16-foot high concrete tilt-up wall described as enclosing the entire outdoor sales area will be required on the north and east sides of the outdoor sales area only; and that a screen fence will be pexmissible on the south side, since the storage area for lumber etc.~ will not be visible from any streets. 5. That there are exceptional or extraordinary circumstances or conditions applicable to the property involved or to the intended use of the property that do not apply generally io the property or class of use in the same vicinity and zone. 6. That the requested variance, as approved, is necessary for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone, and denied to the property in question. 7. That this variance is granted subject to the completion of Reclassification No. 68-69-10. 2. That a Parcel Map to record the approved division of subject property 6e submitted to c;ie City of Anaheim for approval and then be recorded in the office of the Orange County Recorder. 3. That trash storage areas shall be provided in accordance with approved plans on file with the office of the Director of Public WorRs. 4. That fi~e hydrants shall be installed as required and determined to be necessary by the Chief of the Fire Department. 5. That any air-conditioning facilities proposed shall be pxoperly shielded from view. b,. That Condition'Nos_ 2~ 3, 4, and 5, above mentioned, shall be complied with prior to final buiiding and zoning inspections. 7.
