PC69-84 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM THAT PETITION FOR VARIANCE NO. 2~~4 gg APPROVED .1 ~ •l •I . , .~ ' ~ '~ WHEREAS, the City Planning Commission of the City of Aneheim did receive a verified Petition for Variance from ANAHEIM HOTEL CAMPANY, 7 Freedman Way, Anaheim, California 92802, Owner of certain real property situated in the City of Anaheim, County of Orange; State of California, described in Exhibit "A" attached hereto and referred to herein as though set forth in fullo ; and WHEREAS, the City Planning Commission did hold a public hearing et the City Hall in the City of Anaheim on April 21, 1969, et 2;00 o'clock P.M., notice of said public hearing heving been duly given as required by law end in accordeace with the provisions of the Aneheim Municipal Code, Chepter 18.68, to hear and consider evidence for and against said proposed varience and to investigete end meke Eindings and recommendations in connection therewith; and WHEREAS, ~eid Commission, efter due inspection, investigation, and study made by itself end in its behelf, and after due consideretion of all evidence and reports offered at seid hearing, does find and determine the following fects: 1. Thet the petitioner requests a veriance from the Aneheim Municipel Code as fol lows, to permit the conctruction of two free-standing signs on subject property: (a) SECTION 18.37.040(B-4) - Location of free-standinq siQns fro~r abuttinq prooertv. (Minimum 120-foot separation distance in this case required; sican No. 1- 5 feet from abutting property line, and sion ~'o. 2- 35 feet from abutting property line proposed). (b) SECTIOtd 18.37.040(B-1) - Minimum distance of a free-standina sian from a roof sign. That thare ara exceptional or extraordinary circumstances or conditions applicabie to the proper~y involved or to the intended use of the property that do not apply generaily to the property or class of use in the same vicinity and zone. 3. I'hat the requesi:ed variance is necessa*y for the preservation and enjoyment of a substantial property right possessed by other property in the same vicinity and zone, and denied to the property in question. 4. That the requested variance will not be materially detrimental to the public welfare of injurious to the property or improvements in such vicinity and zone in which the property is located. 5. That although the proposed signs are larger than permitted by code for directional signs, subject signs are designed primarily to direct internal traffic on a large hotel complex, and will not be used as advertising signs, since their location is more than 200 feet from any public right-of-way, and further, the petitioner stipulated to single faced signs. That subject property shall be developed substantially in accord;nce with plans and specifications on file :vith the City of A~iaheim, marked Exhibit Nos. 1 and 2, provided, however, that said free-standing signs shall be single faced, as stipulated to by the petitioner.
