A[~ID MILDRED SEAPY, 1253 Pearl Street, Anaheim, California 92801, Owners; ROBERT S. MC MICHAEi:, 469-A West Valencia Drive, Fullerton, California 92632, Agent of certain real prop~y ; situated in the City of Anaheim, County of Orange, State of California, described as commencing : at a point 658.7 feet North of a stake marked "W.N,H." and "H.C.K." on the South line of Section Nine (9), Township Four (4) South, Range Ten (10) West, S. B. B, 8, M, in the City of Anaheirn ~-=~~... the sam~ being the Southwest corner of a 20 ac.ce tract sold by D.VJ.C. Cowan to Dr. Wm. N. Hardin, ~~ ' by deed recorded in book 34, page 457 of Deeds, records of Los Angeles County, running thence North 365.3 feet, more or less, to a corner stake; thence East 363.7 feet to a corner post marked r "H.C.K."; thence South 365.3 feet thence West 363.7 feet to the point of neginning. ; end ,; WHEREAS, the City Plenning Commission did hold a public hearing at the City Hall in the City of Aneheim on April 21~ 1969~ at 2:00 o'clock P.M., notice of said public heorin havin been dul lew and in accordaece with the provisions of the Anaheim Municipel Code, Chepter 18.68, to hesr and c os der evidence for and against said proposed variance and to investigate end meke findin~s end recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigetion, end study mede by itself and in its behalf, and after due consideretion of all evidence end reports offered at seid hearinQ, does find and detecmine the following facts: 1. That the petitioner requests a veriance from the Aneheim Municipal Code, as follows, to ~ermit the development of a 10-lot subdivision with duplexes: (a) SECTION 18.28 050(1-b) - Minimum lot width. (70 f eet required;'8 lots varying from 55 to 63 feet wide proposed). ;i (b) SECTIOIJ 18,28 050(6-b-2) - Minimum setback from an interior lot line. (13, 12, -~` 11, and 10 feet required; all lots at 5 f eet proposed). f'. (c) SEGTION 18.28.050(10-e) - Re uired screeninq of parkinq facilities from adiacent ~ treet. ~Screenina of parking facilities from adjacent streets required; two duplex garage units with no screen- i in~c proposed). Remaining R-A Zone Portion: j (d) SECTION 18.16 050(2-a) - Minimum lot area. (1 acre required; approximately 15,000 square feet proposed). ~' (e) SECTION 18,16 050(2-b) - Minimum lot width. i (140 feet required; approximately i 95 f eet p.rcpos ed) . 2. That waiver of 1(b) above is granted, in part, to permit the requested deviations from code required setbacks from interior,,lot lines except for the required setbacks alonq the north boundary of subject property (Lot Nos. 4 and 5 of Tract No. 6819) which shall be ~". in conformance with minimum standards specified in the R-2 Zone. 3. That ~.vaiver of 1(d) and (e) above, are denied on the basis that the petitioner ~ stipulated to r~classification of Parcel No. 2 the R-2, Multiple Family Residential, 2one, and therefore, said waivers will ncc be necessary. That the thare art exceptional or extroardinary circumstances or conditions applicable !~ : to the property invo!ved or to the intended use of the property, as granted, that do not apply generally to the property or class of use in the same vici.nity and zone. 5. That the requested variance, as granted, is necessary for the preservation and enjoy- ment of a substantial property right possessed by ~ther property in the szme vicinity and zone, and denied to the property in question. 6. That this variance is granted subject to the completion of Reclassification No. ~'.•I 68-69-87. 2. That the sid:~>;lks shall be installed along Pearl Street and the new street, a=_ required by the City Engi, eer and in accordance with standard plans and specifications on file 'n the office of the Cit,~ Er,gineer. 3. That Condition No. 2, above mentioned, shall be complied with prior to Final building and zoning inspections. 4.
