PC70-102 A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM THAT PETITION FOR CONDITIONAL USE PERMIT 1185 gE DENIED 1VHEREAS, the City Planning Commission of the City of Anaheim did receive a veriEied Petition for Con- ditional Use Permit from JCSEPH F. GRANT, 4662 Howard Street, Los Alamitos, California 90720, Owner of certain real property situated in the City of Anaheim, County of Orange, State of California, described as Lot Nos. 3, 4, 5, and 6, of Tract No. 1098. f ~ ~ , ; and WHEREAS, the City Planning Commission did hold a public hearing at lhe City Hall in the City of Aneheim on .TUne 15, 1970~ at 2:00 o'clock P.M., notice oE said public hearing having been duly given as required by law and in accordance with the provisions ot the Anaheim Municipal code, Chapter 18.64, to hear and consider evidence for and against said proposed conditional use and to investigate and make findings and recommendations in connection therewith; and WHEREAS, said Commission, after due inspection, investigation, and study made by itself and in its be- ~` half, and after due consideration of all evidence and reports offe:ed at said hearing, does find and determine the " following facts: 1. That the proposed use is properly one for which a Conditional Use Permit is authorized by Code: Se:.tion 18.64.020(1-b) to wit: establish a child nursery and private educational in~titution, with waivers of: a. SECTION 18.24.030 - Minimum re uired front ard setback. (25 feet required; 0 feet proposed . b. SECTION 18.62.060(a) - Maximum permitted siqn area. (1 square foot permitted; 32 square feet proposed). 2. That the petitioner withdrew his two waiver requests. 3. That approval of the proposed use would establish an undesirable commercial use in a residential area. 4. That the proposed use would increase the traffic on a local residential street. 5. That the City of knaheim has many homes fronting on arterial streets that have been determined to be appropriate for conversion to comrnercial uses, and the proposed school fac;lity would be far more aopropriate at one of these ]ocations than within a single-family subdivision. 6. That the proposed use will adversely affect the adjoining land uses and the 9rowth and development of the area in which it i.s proposed to be located. 7. That the granting of the Conditional Use Permit will be detrimental to the peace, health, safety, and generai welfare of the Citizens of the City of Anaheim. 8.
