PC70-103 ~ l ~'' ;~`~I ~~~~ ~ F;~ ~ A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM THAT PETITION FOR VARIANCE NO. 2181 BE GRANTED WHEREAS, the City Planning Commission of the City of Anaheim did receive a verified Petition for Varience from CREDIT DATA CORPORATION, 1761 West Katella Avenue, Anaheim., California 92804, Owner; SECURITY PACIFIC NATIONAL BANK, 312 West 5th Street, Room 901, Los Angeles, California 90013, Agent of certain real property situated in the City of Anaheim, County of Orange, State of California, described as Lot No. 12 of Tract No. 3258. ; ena 15'HGREAS, the City Planning Commission did hold a public hearing at the Ciry Hall in the City o[ Anaheim on June 15 ~ 1970, at2 :00 o'clock P.M., notice of said public hearing having been duly given as required Uy iaw and in accordance with the provisions of the Anaheim Municipal Code, Chapter 1$.68,to hear and consider evidence for end ugainst said proposed variance and to investigate and make findings and recommendations in connec- tion therewith; and ~S'HEREAS, said Commissi~n, after due inspection, invest'sgation, and study made by itself and in its behelf, ~n-1 after due consideration of all evidence and reports offered at s~id hearing, does find and determine the following Eacts: - 1. That the petitioner requests a variance (rom the Anaheim Municipal Code~ as folloWS ~ to ereCt a rre~-standirg sign on subject property: SECTION 18.62.090(B-1) - Maximurn permitted free-standin si n hei ht. 25 feet permitted; 44 feet. 10 inches proposed . ;~. 7hat waiver of the 25-foot maximum permitted height of the sign to allow a 44-foot, 10 i~cn sign is hereby granted on the basis that although it would be within 300 feet of _•e~i~.i~~nlial uses, the height of the building would obstru::t any intxusion into the r~,=.irieniial area. ~. ;~~e; the proposed sign would be less in square footage than the existing roof sign, vrhic:i~ t~:e ~etitioner Stipulated would be removed. 4. That there are exceptional or extraordinary circumstances or conditions applicable to the property involved or to the intended use of the property that do not app-y generally to the property or cless of use in the same vicinity and zone. ~. That the requested variance is necessary (or the preservation and enjoyment of a substantia! property right possessed by other property in the same vicinity and zone, and denied to tfie ptoperty in question. 6. That the owner of subject property shall pay to the City of Anaheim the sum of 15~ f per front foot along Katella Avenue and Humor Drive, for tree planting purposes. 2 That adequate clearance of existing electrical lines shall be provided as required b `.i t~ ~~ .4~* ~ . y the Electrical Division, Department of Public Utilities, and the State of California G.O. 95. 3. That subject property shall be developed substantially in accordance with plans and specifications on file with the City of Anaheim, marked Exhibit Nos. 1, 2, and 3.
