PC?0-105 A RESOLUTION OF THE CITY PLANNING COMh1ISSI0N OF THE CITY OF ANAHEIM RECOMMENDING TO THE CITY COA[VCIL OF THE CITY OF ANAHEIM THAT PETITION FOR RECLASSIFICATION N0. 69-70-62 gE APPROVED WHEREAS, the City Planning Commission of the City of Maheim did initiate a verified Petition for Reclassification on certain real property situated in the City of Anaheim, County of Orange, State of California, described as the southwesterly 227.22 f?et, measured from ~ the centerline of Lemon Street of the northwesterly 120.00 feet of that portion of Lot 26 of Anaheim Extension, as per Map of Survey made by Wm. Hamel and filed for record in the ~ office of the County Recorder of Los Ange:es County. Beginning at the southeast corner of said Lot 26; thence northerly 503.19 feet along the easterly line of said lot to i;he southeasterly corner of the land conveyed to 0. A. Mullinix by deed recorded January 25, 192.4 in Book 506, page 256, Deeds; thence westerly 612.49 feet along the southerly line of said land conveyed to Mullinix, to a point on the westerly line of said Lot 26, northerly 331.89 feet from the southwest corner of said Lot 26; thence southerly 331.89 feet along said westerly line to said southwest corner; thence easterly 633.60 feet to the point of beginning. Jacaranda Or3nge, California 92667 ; end WHEREAS, the CityPlenning Commission did hold a public hearing et the CityHall in the City ot Aneheim on June 15, 1970~ at 2:00 o'clock P.M. notice of seid public hearing heving been duly given as required by law and in accordence with the proviaions of the Maheim Municipel Code, Chupter 18.72, to hear and consider evidence tor end egainst said proposed reclessification and to investigate endmeke findings endrecommendetions in connection therewith; and WHEREAS, seid Commission, after due ir.sy. ~~on, investigation, and study mede by itself end in its be- half, end efter due consederation of nll evidence ..~~~ ..ports otfered et said hearing, doe~ find and determine the following [ecty: 1. Thatthe Pla3nning Comn,i:>sion pro~oses a reclassifi~:ation of the ahove described property from the C-1, ~enErzl Commercial, Zone to the R-3, Nultiple-Farnily Residential, Zone to establish the most appropriate zonin~~ for subject pz~,F~erty. 2. That the scope of the p~oposed reclassification, if approved, does not warrant an amendment to the General Plar~ at. the present time; however, its relationship to the Generai 1>lan symbol will be considered at the next annual review. 3. That the proposed reclassification of subject property is necessary and/or desirable for the orderly and proper development of the community. 4. That the proposed reclassification of subject property does properly relate to the zones and their permitted uses locall.y established in close proximity to subject property and to ihe zones and their permitted uses generally established through- out the community. 5. That subject property was developed with a 24-unit apartment complex at the time when multipl?-family residential uses were permitted in the C-1 (General Commercial), Zone. .+1x ~ R~ _ 1_ NOW, THEREFORE, BE IT RESOLVED that the Aneheim City Plenning Commiaaion does hereby recommend to the City Council oE the City of Aneheim thet subject Petition for Reclassiflcetion be epproved end, by ao doing, thet Title 1&Zoning of the Anaheim Municipal Code be emended to exclude the above described property from the C-1, General Commer~ial, Zone and to incorporate said described property into the R-3, Multiple-Family Residentia:, Zone, upon the following conditions which are hereby found to be a necessary prerequisite to the proposed use of subject property in order to preserve the safety and general welfare of the Citizens of the City of Anaheim. 1. That the owner of subject property shall deed to the City of Anaheim a strip of land 32 feet in width from the centerline of the street along Lemon Street, for street widening purposes. 2. That the owner of subject property shall pay to the City of Anaheim the sum of $2.00 per front foot along Lemon Street, for street lighting purposes. 3. That the owner of subject property shall pay to the City of Anaheim the sum ;~ of 15¢ per front foot along Lemon Street, for tree planting purposes. 4. That Condition Nos. 1, 2, and 3, above mentioned, shall be complied with at such time as a building permit is issued for any substantial addition or alteration to the property.
