Box ~ 524, Room 1311, San Diego, California 921i.2, Agent of certain real property situatcd in the City of Anaheim, County of Orange, State of California, described as Lot No. 13 of Tract No. 3258. i, I° ; end WHEREAS, the City Plenning ComR~ission did hold a public hearing et the City Hall in the City of Aneheim on ; June 29, 1970, at 2:00 o'clock P.M. notice of seid ublic hearin havin been dul ~ lew and in accordence with the provisions of the Anaheim Municipal Code, Ch pter 18.72, to hear and considere idence _ for end against said pcoposed reclassification and to investigate and make findings nnd recommendetions in connection therewith; and ~9HEREAS, said Commission, efter due inspection, investigetion, and study mede by itself and in its behelE, and efter due consideration oE all evidence end reports offered at said hearing, does find and determine the following facts: 1. That the petitioner proposes a reclassification of the above described property from the R-A~ Agricultural, Zone to the C-1, General Commercial, Lone. 2. That the proposed reclassification is in conforrnance with the General Plan. ! 3. That the proposed reclassification of subject property is necessary and/or desirable tor the ordedy and pro- ~' per development of the community. ~; 4. Thet the proposed reclassification of subject property does properly relete to the zones and their permitted !` uses locally established in close proximity to subject ptoperty end to the zones and their permitted u:,o:. generally esteb- Sished throughout the community. ,~ . •'- ~ ,~ ~ ,,j ..~ R.A _ 1- ~ ,; I: ~ ~ .~....,-,_,_.-~~.,.,~ .,.:~ .,:.. ,.:: , , ~~ .....:._ ~~ ~ -- --. _..~,~ ~ ---- - - ~ ~~, _ --- ~ r ~' ~ ~ 4~ , ~` ~~ NOW, THEREFORE, BE IT R[SOL'VEll that the Anaheim City Planning Comrt~ission does hereby recommend to the City Council of the City of Anaheim tnat subject Petition for Reclassification be approved and, by so doing, that Title 18-Zoning of the Anaheim Municipal Code be amended to exclude the above described property from the R-A, Agricultural, Zone and to incorporate said described property into the C-1, General Commercial, Zone, upon the following conditions which are hereby found to be a necessary prerequisite to the proposed use of subject property in ordez to preserve the safety and general welfare of the Citizens of the City of Anahaim. 1. That street lighting facilities along Katella Avenue and Humor Drive shall be installed as required by ihe Director of Public 1ltilities and in accordance wi±h standard p~an~ ar,d specifications on file in the office of the Director of Public Ut?lities; and that a bond in an amount and form satisfactor?~ to the City of Anaheim shall be posted with the City to guarantee the installatien of the above mentioned requirement. 2. That the owners of subject property shall pay to the City of Anahei~ the sum of 15~ per front foot along Katel.la Avenue and Humor Drive, For iree planting purposes. 3. That the driveways sha11 be installed along ~atella Avenue and yumor Drive as required by the City Engineer and in accordance with ab~rr;~e~ pla.ns on file in the office of the City Engineer. 4. That trash storage areas shall be pro•,irru i~, accordance with approved plan.• on file with the office of thc Director of Public Works. 5. That fire hydrants shall be installed as req:ired ~nd determined to be necessa*~ .y the Chiaf of the Fire Department. • 6. That subject property shall be served by underground utilities. 7. That a 6-foot masonry wall sha;l be constructed along the nor.th property line. 8. That all air-conditioning facilities shall be properly shielded from view and the sound buffered from adjacent residences. 9. That any parking area lighting proposed shall be dovm-lightin9 of a maximum neight of 6-feet, which lighting shall be directed away from the property lines to protect the residential integrity of the area. 10. That subject property shall be develooed substantially in accordance with plans and specifications on file with the City of Anaheim, rnarked Exhibit Nos. 1, 2, and 3. 11. Prior to the introduction of an ordinance rezoning subject property, Condition Nos. 1 and 2, above mentioned, shall be completed. The provisions or rights granted by this resolution shall be come null and void by action of the City Council unless said conditions are complied with within one year from date hereof or such further time as the City Council may grant. 12.
