PC 70-126.. . t ~ - `. .[ ; ~ RESOLUTION NO. pC70- i26 A RESOLUTION OF THE CITY PLANNING COIvIMISSION OF THE CITY OF ANAHRiM RECOMMENDING TO THE CITY COUNCIL OF THE CITY OF ANAHEIM THAT PETITION FOR RECLASSIFICATION NO. 70-71-1 gE APPROVED WHEREAS, ~,ne City Planning Commission of the City of Anaheim did recelve a verified Petition for Reclassifica- tian from TOM SHOZI, 3512 West Orange Avenue, Anaheim, California 92$04, and PACIFIC TELEPFiONE AND TELE~RAPH COMPANY, 525 B Street, Room 1311, San Diego, California 92112, Owne*s of certain real property situated in the City of Anaheim, County of Orange, State of California, described as that portion of the IJortheast quarter of the Southeast quarter of Section 15, Township 4 Southy Range 11 West, in the Rancho Los Coyotes, as shown on a Map by rharles T. Healey upon survey made by him about 1870 for the Stearns Ranchos Company, Beginning at a point on the East line of said Section 15, North 2366.76 feet from the South- east corner thereof; thence West 180 feet; thence North parallel with said East line to the North line of saici Southeast quarter of Section 15; thence East 180 feet to the Eost lir.e thereof; thence South 302.07 feet to the point of beginning. ; end WHEREAS, the City Planning Commission did F.old a public hearing et the City Hell in the City of Anaheim an Ju1y 13~ 1970, ~t 2:00 o'clock P.M. notice of seid public hearing having been duly given as required by !aw end in aecordance with the provisions of the Anaheim Municipal Code, Chapter 18.72, to heer and consider evidence for end ageinst said proposed reclassification end to investigate and make findings and recommendations in connection therewith; end WHEREAS, said Commission, aEter due inspection, investigation, and study made by itself end in its behalE, and after due considerat:on of all evidence and reports offered at seid hearing, does find and determine the following fects; , 1. That the petitioner proposes a reclessificetion of the above described property from the R-Ai Agricui tural, Zone to the C-1, General Commercial, Zone. ~~ 2. That the il proposed reclassification is in conformance with the Anah~im General ;i Plan and the existing land uses in the vicinity. 3. Thet the pcoposed reclessification of subject property is necessary and/or desirable for the orderly end pro- per development of the community. 4. That the proposed reclassificetion of subject property does properly relete to the zones and their permitted uses locelly esteblished in close proximity to subject property and to the zones and their permitted uses genecally estab- lished throughout the community. 5. That the proposed reclassification of subject property requires the dedication and improvement of abutting streets in accordance with the Circuiat9.on Element o~ the General PJ.an, due to the anticipated increase in traffic ~,vhich ~vill be generated by the intensifi- cation of land use. R-A ~1 r, ~ ' 1 NOW, THEREFORE, BE IT kESOLVED that the Anahei~ City Planning Commission does hereby recommend to the City Council of the City of Anaheim that subject Petition for keclassification be approved and, by so doing, that Title 18-Zoning of the Anaheim Municipal Code be amended to exclude the above described property from the R-A, Agrir.ultural, Zone dn~ to incorporate said described property into the C-1, General Commercial, "Lone, upon ~he follov~ing conditions lvhich are hereby found to be a necessary nrerequisite to the proposed use of subject property in o*der to preserve the safety and general welfare of the Citizens of the City of Anaheim. 1. That the ovmer of subject property stiall deed to the City of Anaheim a strip of land 45 feet in widtn irom the centerline of the street along Orange Avenue for street widening purposes. 2. That all engineering requirements of the City of Anaheim a1on9 Orange Avenue, including preparation of improvement plans and installation of all improvements, such as curbs and gutters, sidewalks, street grading and paving, drainage facilities, or otti~r appurter.ant v~ork shall be complied with as required by the City Fngineer and in accordance with standard plans and soeci- fications on file in the office of the City Engineer; that stieet lighting fac,lities along Orange and Knott Avenues shall be insta]?ed as required by tfie Director of Public Utilities an~ in accord- ; ance with standard plans and speci.~ications on file in the office ef the Director or Public Utilities; and that a bond in an amount and form satisfar,tory to the City of Anaheim shall. be oost- ed with the City to yuarantee the installation of the aoove mentioned requireR~ents. ~ 3. That the owner of subject property shall pay to the City of Anaheim the sum of 15Q per front foot along Orange and Knott Avenues, for tree plantina ourposes. 4. That trash storage areas shall be provided in accordance with approved p]ans on file ~vit!i the office oi the Director of Pubiic 'Norks. 5. That fire hydrants shall be installed as required and determi~ed to be necessary by the Cliief of the Fire Department. 6. That all air-conditioning facilities shall be properly shielded from vielv. 7. That any par!<ing area lighting proposed shall be doe,~n-]ionting o; a maximum heiaht of 6- feet, which lighting shall be directed away ;rom the property lines to protect tiie residential integrity of the area. 8. That subject property shall be served by undei•ground utilities. 9. Prior to the introduction of an ord:nance rezonino subject oroperty~ Condition tdos. 1, ?_, and 3, above mentioned, shall be completed. Tfie provisions or rights granted by this resolution shall becorne null and void by action of the City Council uniess said conditions are complied with within 180 days from date hereoi, ~vhichever occurs first, or such further time as the City Council may grant. 10.
