TOLAR 1405 Scarborough Lane, Anaheim, alifornia 92804, qgent of certain real property situated in the City of Anaheim, County of Orange, State of California, described as that ' portion of the Southeast quarter of the Northeast quarter of Section 17, Township 4 South, ~g~ Range 10 West, in the Rancho Los Coyotes, as per map recorded in Book 51, Page 10, Miscellan- i eous hlaps, in the of:ice of the County Recorder of said County. EXCEPT the Southerly 66 feet. : Pnd WHEREAS, the City Planning Comrt~ission did hold a public hearing et the City Hall in the Ctty of Anaheim on July 13~ 19i0~ at 2:00 o'clock P.M. notice of seid public hearin hevin been du1 taw a~~d in accordence with the provisions of the Anaheim Municipel Code, Ch pter 18.72, to hear ande onsiderevi ence ~ for end ageinst seid proposed reclassification and to investigete end make findings end recommmdetions in connection ~ therewith; end ~ 1VHEREAS, said Cornmission, e(ter due inspect3on, investigation, end study mede by itself end in its behalf, and after due consideration of ell evidence and reports offered at said hearing, does find end determine the following fecta: 1. That the petitioner proposes a reclassification of the ebove described propetty from the R-A~ AgiiCUltuTal, Zone to the G 1, General Commercial, Zone. ~ 2. That the ~ proposed reclassification is in conformance with the General Plan. ~ 3. Thet the proposed reclesslficetion of subject property is necessary and/or desireble (or the orderly end pro- per development of the community. 4. That i;he proposed .reclassification of subject property does property relate to the zones and their permitted ~ses locally estab?ished in close proximity to subject property and to the zones and their permitted uses generally established throughovt the community. 5. That the proposed reclassification of subject property requires the dedication and improvement of abutting streets and alleys in accordance ivith the Circulation Element of the General Pian and Area Dev?lopment Plan No. 95, due to the anticipated increase in traffic which will be generated by the intensification of land use. 6. That accPSS to the proposed alley from the residential properties to the west shall be protiibited in order that the amount of vehicular traffic using the alley may be kept to a ~~~inimum since the alley wil7 empty only onto Euclid Street. ~. That the oetitioner stipulated to increasing the height of the existing masonry wall to meet the 6-foot minimurn reo,uired wall. 8. That 4 oersons appeared representing 9 persons present in the Council Chamber and a petition signeo by ?_5 persons, in opposition to the requirement of an alley to the rear of subject property. NOW, THEREFORE, BE IT RFSOLVED that the City ~lanning Commission does hereby recommend to the City Council of the C~ty of Anaheim that subject Petition for Reclassification be approved and, by so doing, that Title 18-Zoning of the Anaheim Municipal Code be amended to exclude the above described property from the R-A, Agricultural, Zone and to incorporate said described property into the C-1, General Commercial, Zone, upon the following conditions which are hereby found to lie a necessary prerequisite to the proposed use of subject property in order to preserve the sa:ety and general wel.fare of the Citizens of the City of Anaheim. 1. That the owner of subject property shall deed to the City of Anaheim a strip of land ~. 53 feet ir, width from the centerline of the street along Euclid Street for sreet widening ,,"_:~~ , purposes; and that an irrevocable offer of dedication of 20 feet along the west property line ~~ and 10 feet along the north prooerty line for alle ~ ,~ y purposes sf•~all be submitted to t~ie City of Anaheim. ~, ~~ 2. That the ovmer of subject property shall pay to the City of Anaheim the sum of 15~ { per front foct along Euclid Street, for tree planting purooses. 3. That the ov,•ner of subject prope~ty shall pay to the City of Ananeim the sum of $2.00 i per front foot alo~;g Euclid Street, for street lighting purposes. ~ 4. That a bord in an amount and form satisfactory to the City of Anaheim shall be posted 1 with the City to guarantee the preparation of improvement plans and installation of all ~m- j provements for the alley. ,i. 5. That t*ash storage areas shall be provided in accor~ance with approved plans on file with the office of the Director of Public VJorks. ~ 6. That a 6-foot masonry wall shall be constructed aleng the north, south and west property lines. ~. That the existing structure shall be brought up to the minimum standards of the City I of Anaheim, including the Uniform Building, Plumbing, Electrical, Housing, Mechanical, and ~ Fire Codes as adopted Uy the City of Anaheim. i B. That a parcel map to record the approved division of subject property be submitted to ; and approved by the City of Anaheim and then be recorded in the office of the Orange County ; Recorder. ~ 9. That subject property be developed in accordance with Area Development Plan No. 95. I 10. That the vehicular access rights, except at street and/or alley openings, to Euclid i Street shall be dedicated to the City of Anaheim; provided however, that temporary access from subject property to Euclid Street shall be permitted until such time as the City demands improvement of the required alleys. 11. That fire hydrants shall be installed as required and determined to be necessary by ', " the Chief of the Fire Uepartment. " 12. That all air-conditioning facilities shall be properly shielded from view. 13. That any parking area lightiny proposed shall be down-lighting of a maximum height of 6-feet, which lighting shall be directed away from the property lines to protect the resi- dential integrity of the area. 14. That. the final par~:ing plans shall be approved by the Development Services Depart- ment, and any landscaped areas in the parking area shall be ~rotected with 6-inch hiyh concrete curbs, and concrete wheel stops shall be provided for parking spaces as required by the Developnent Services Department. 15. That subject property shail be developed substantially in accordance with plans and specifications on file vaith the City of Anaheim, marked Exhibit Nos. 1 and 2, provided ! that necessary revisions are made to comply with Area Development Plan No. 95. ~ 16. Prior to the introduction of an ordinance rezoning subject property, Condition Nos. t ], 2, 3, and 4, above mentioned, shall be completed. The proviszons or rights granted by ; this resolution shall become null and void by action of the City Council unless said conditions are complied with within one year from the date hereof, or such further time as ', the City Council may grant. 17.
