A RESOLUTION OF THE CITY PLANNTNG COMMISSION OF THE CITY OF ANAHEIM
THAT PETITION FOR VARIANCE N0. 2196 BE APPROVED
WHERE~aS, the City Planning Commission of the City of Aneheim did receive a verified Petition Eor Varience from
MARIAM C. VIERRA, 1232 South Brookhurst Street, Anaheim, California 92804, Owner;
PONDERC6A HOMES, 4570 Campus Drive, Suite 10, IJewport Beach, California, Acant of certain
real property situated in the City of Anaheim, County of Orange, State of California,
described in Exhibit "A" attached hereto and referred to herein as though set forth in full.
WHEREAS, the Clty Plorsning Commisaion did hold a public hearing at the City Hall in the City of Anaheim on
AuguS t 24, 1970~ et 2:00 o'clock P.M., notice of seid public hearing heving been duly given es required by
lew and in accocdence witl: the provisions oE the Aneheim Municipel Code, Chepter 18.68, to hear and consider evidence for
end egelnst seid proposed variance end to inveatigete end meke findings end recommendetiuns in connection therewith;
end
WHEF2EAS, said Commission, eftes due inspection, investigetion, end ~tudy mede by itself end in its behelf,
and efter due considerntion of ell evidence and reports offered at seid heering, does find end determine the following
facts:
1. Thet the petitioner requeats a verience from the Anahelm Municipal Code~ as follows, to eStaLlish 2
one and two-story, 228-unit apartment compiex on subject property:
a. SECTiON 18.28.050(7) - Minimum distance between buildinqs (19, 28 and
36 teet required; 10, 15 and 20 feet proposed).
b. SECTIODI 18.28.050(5-b) - Maximum heioht within 150 feet of R-A zoned prooerty.
(one-storv permitted; two-story proposed).
c. SECTION 18.28.050(6-b-2) - Minimum required side yard setbac}~. (14 feet; re-
quired; 10 feFt proposed).
2. That there are exceptional or er.trao:dinary circumstances or conditions applicaU.e
to the property involved or to tt~e int_nded use of the property that do not apply generally
to the propert~~ or class of use in the same vicinity and zone.
3. That the requested variance is necessary for the preservation and enjoyment. of ~
substantial property right possessed by other property in the same vicinity and zor.e, and
denied to the property in question.
4. That tf~e requested variance will not be materially detrimental to the public welfa*e
or injurious to the property or improvements in such vicinity and zone in whicfi tlie F~ro~erty
is located.
5. That the developer stipulated to improving the appearance of the northerly acceas
drive by the use of landscaping or appropriate design techniques.

~ NOW, THEREFORE, BE IT RESOLVED thet the Anaheim City Planning Commission does hereby grant subject

~ Petition for Variance, upon the following conditions which aie hereby found to be a necessary prerequisite to the pro-
' posed use of the subject property in order to preserve the safety and general welfare of the Citizens of the City of
j Anaheim.
' 1. That this variance is granted subject to the completion of Reclassification No.
70-71-9. •
2. That subject property shall be developed substantially in accordance with plans
and specifications on f.ile with the City of AnaF~eim, ma~ked Er.hibit Nos. 1, 2, and 3,
provided however, that the circulation pattern and landscaping treatment therein shal:
be revised and submitted to the Development Services Department fo: approval.
