THON50N, 2912 Collyer Lane, Anaheim, California 92806, Agent of cer•;:~in real property situated in the City of Anaheim, County of Orange, State of California, described as Lot No. 3 of Tract No. 42b, recorded in Book 17, Page 45 of Miscellaneous Maps. ~'i ,: ; end WHEREAS, the City Plenning Commission did hold a public hearing at the City Ha11 in the City of pneheim on SPptember 10~ 1970~ at 2:00 o'clock P.M., netice of seid public hearing having been duly given as required by law and in accordance with the provisions o( the Anaheim Municipel Code, Chapter 18.68,to hear and consider evidence for and ugainst seid proposed verience and to investigate end make finding~ and recommendations in connec- tion therewith; and WHEREAS, seid Commissi~n, efter due inspection, investigetion, and study made by itself end in its behelf, and after due consideration of all evidence and reports offered at said hearing, does find end determine the following facts: 1, That the petitioner requests a veriance trom the Anaheim Municipal Code as follows ~ to permit the construction of an additional dwelling unit on subject property: a. SECTION 18.~8,050(3) - Minimum floor area per dwellinq unit. (700 square `~,~ feet required; 43i square feet proposed). b. S ECTION 18.28.050(5-b) - PAaximum buildina heipht within 150 feet of an R 1 Zone. (One-story permitted; two-storv proposed). 2. That there are exceptional or extraordinary circumstances or conditions appliceble to the property involved or to the intended use of the p~operty that do not apply generally to the property or class of use in the same vicinity and zone. 3. That the requested vnriance is necessery for the preservation end enjoyment of e substentiel property right possessed by other property in the some vicinity end zone, and denied to the property in question. 4. That the requested veriance will not be materielly detrimental to the public welEare or injurious to the prop- erty or improvements in such vicinity ond zone in which the property is loceted. 5. That because of the two types of uses proposed for subject property, in order to insure that adequate parking will be available, the Planning Cornmission amended cenditions of approval of Varianc?
