PC70-174 ~ A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM THAT PETITION FOR VARIANCE N0. 22~6 BE GRANTED WHEREAS, the City Planning Commission of the City of Anaheim did receive a verified Petition for Variance from FRPNK J. STUECKLE, 842 North Zeyn, Anaheim, California 92E05, O,vner; SIGN INDUS7'RIES, INCORPORATED, 2632 North Ontario Street, Burbank, California 91504, Agent of certain .real property situated in the City of Anaheim, County of Orange, State of California, described Vineyard Lot H-4, Anaheim Map 4/629-630 and Lot 20, Stueckle Subdivision, Orange County. ~ '11t ; and WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City of Anaheim '' on S eptember 21 ~ 1970, at 2:00 o'cloclc P,M., notice of sai~ aublic hearing having been duly given as required by (aw and in accordance with the provisions of the Anaheim Municioel Code, Chapter 18.G8.to hear and consider ^ evidence for and against said proposed variance and to investigate and n;ake (indings and recommendations in connec- tion therewith; and WHEREAS, said Commissinn, after due inspection, investigetion, and study made by itself an~l in its behalf, ; and after due consideration of all evidence end reports offered at said hearing, does Eind and determine the following facts: 1. That the petitioner requests a variance (rom the Anaheim Municipal Code as follot~as: SECTI0~1 1$.62,090(b-~) -- Minimum sipn display surface elevation ( 8 feet required; 9 inches proposed). 2. That the petitioner is proposing a 4-foot by 24-foot pylon-type si9n on subject Froperty 3. That the abovementioned waiver is granted on the basis tf~at the proposed sigr~ would not ~~e detrimental to either motorists or pedestrians. d. That there are exceptionel or extraordinary circumstances or conditions applicable to the propetty involved or to the intended use of the propecty that do not apply ganerally to the property or cless of ase in the same vicinity and zone. 5. That the requested variance is necessary (or the preservation and enjoyment of a substantiat property right ' possessed by other property in the same viciniry and zone, and denied to the property in question. 5. That the requesied varience will not be materially detrimental to the public welfare or injurious to the prop- erty or improvements in such vicinity and zone in which the property is located. 7. That approval of Chis sign waiver shall not be construed as settinq a precedent for similar requests in the City, since each request should be reviewed and considered on its own merits. 8. That the petitioner stipulated to removzl of all illegal and non-conforming signs from the prnperty. I ' ~ Q , ~x V1-G _1_ ----.:;, ~ " t ~ ~ NOW, THEREFORE, BE 1T RESOLVED that the Aneheim City Planning Commission does hereby grant subject Petition for Variance, upon the Eollowing conditions which are hereby found to be a necessary prerequisite to the pro- pased use of the subject property in order to preserve the safety and general welfare of the Citizens of the City of Anaheim: ~ 1. That adequate clearance of existing electrical lines shall be prnvided as required by i the Flectrical Division, Department of Public UtiliLies, and the State of California G.O. 95. l 2. That subject property shall be developed substantially in acccrdance with plans and specifications on file with the City ~f Anaheim, marked Exhibit Nos. 1, 2, and 3. 3.
