Circle, Buena Park, 90620, KENNETH SARVAK, 2840 West Lincoln Avenue, Anaheim, 92801, and

WHEREAS, the City Planning Commission did hold e public hearing at the City Hall in the City of Aneheim on
5eptember 21, 1970~ et 2:00 o'clock P.M., notice of seid public hearing heving been duly given es required by
lew end in accadence wit}~ the provisions of the Aneheim Municipel Code, Chapter 18.68, to hear and consider evidence for
end egeinst said praposed votience and to investigete and meke findings end recommendations in connectian therewith;

WHEREAS, eaid Commission, efter due inspection, in•oestigetion, and study mede by itself end in its behalf,
and efter due consideretion of all evidence and reports offered at said hearing, does find end detecmine the following
facts:
j 1. Thet the petlHoner requests e va:iance from the Anaheim Municipel Code as fo1lo~NS:
a. SECTION 18.28.050(5-b) -_Maximum buildinq heicaht within 150 feet of R-A zoned proper~
(One story permitted; three-storv proposed).
b. SFCTION 18.28.050(5-a) - Maximum buildino I~eicaht of anv buildinq (Two-story perrnitted;
three-story proposed).
2. That the petitioner is requesting approval of the abovementioned waivers in order to
construct a 207-unit three-story apariment complex on subject property.
3. That the aforementioned waivers are granted on the basis that single family resi-
dential uses in all likelihond would not be established on the adjacent R-A parcels, and that
three-story apartment complexes have been approved previously in specific areas of the City.
4. That there are exceptional or axfraordinary circumstances or conditions applicable
to the property involved or to the intended use oi the property i:hat do not apply generally
to the property or class of use in the same vicinity and zone.
5. That the requested variance is necessary for the preservation and enjoyment of a
substantial property right possessed 'oy other property in tf~e same vicinity and zone, and
Jenied to the property in question.
6. That tlle requested variance will nat be materially detrimental to Lhe public welfare
or injurious to the property or improvements in such vicinity and zone in which the property
is located.

i NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hcreby grant subject
, Petition for Varinnce, npon the following conditions which are hereby found to be a necessary prerequisite to the pro-
i posed use of the subject property in order io p:ecerve the safety and general welfare of the Citizens of the City of
' Anaheim.
P' 1. That this variance is granted subject to ihe completion of Reclassification No.
70-71-16.
2. That subject property shal] be developed siJbstantially in accordance with plans
and specifications on file with the City of Anaheim, marked Exhibit Nos. 1, 2, 3, 4, 5, 6, and
7, prnvided however, that landscaping plans for tl~is development shall be submitted'to the
