A RESOLUTION OF THE CITY PLANNING COMMISSION OF THE CITY OF ANAHEIM
THAT PETITION FOR VARIANCE N0. 2214 BE GRANTED
~ WHEREAS, the City Planning Commission of the City of Anaheim did receive a verifiEd Petition for Veriance
~ from PACIFIC TELEPHONE AND TELEGRAPH COMPANY~ P. 0. BOX 524, Roo:n i311, At*_n: Building
Engineer, San Diego, Califox~ia 92112, Owner of certain real ~rop~rty situated in the
City of Anaheim, County of Orange, State of California, desc-ribed as Lot Nos. 2-i6 of
,' Block G of Subdivision of Vineyard Lot D-5.

WHEREAS, the City Planning Commission did hold a public hearing at the City Hall in the City o: Aneheim
~on October 19, 1970~ at 2:00 o'clock P.M., notice of said public hearing having been duly given es requin~d
sby law and in accordance with the provisions of the Anaheim iNunicipal Code, Chepter 18.68,to hear and consider
,evidence for and egainst said proposec' variance and to investigate and make findiags ar,d recommendat~ons in connec-
'tion therewith; and
WHEREAS, said Commissinn, efter due inspection, investigation, and study made by itself and in its behalf,
' and after due consideretion of all evideuce and reports offered at said heering, does find and determine the following
facts:
1. That the petitioner requests a variance from the Anaheim Municipal Code as follows:
SECTTON 18.44.0?_0~1) - Mar.imum buildinca heiaht. (75 feet pernitted; 22 5 feet
p.'nosed).
2. That the petitioner prcpcses to ~rr,:t a 225-foot tower to enclose telephone
microwave ~quipment.
: ~. That there are exceptional ar extraordinary circumstonces or conditions epplicoble to ihe property involved
or to the intended use of the property that do not apply generally to the property or c:ass of use in the same vicinity
i and zone.
4. That the requested variance is necessary (or the preservation and enjayment of a substantial property right
possessrd by other property in the snme vicinity and zone, and denied to the ptoperty in question.
5. That the requested variance will not be materially detrimental to the public welfare or injurious to the prop-
erty or improvements in such vicinity and zone in which the property is loceted.

' NOW, THEREFORE, BE IT RESOLVED that the Anaheim City Planning Commission does hereby grant subject
Petition for Variance, upon the following conditions which are hereby found to be a necessary prerequisite to the pro-
posed use of the subject property in order to preserve the safety and general welfare of the Citizens of £he City of
nnaheim.
1. That subject property shall k~a oe~~eloped substantially in accordance with plans and
specificatior,s on file with the City ef P.naheim, marked Exhibit !~!os. 1, 2, 3, and 4,
provided however, if a 4tf~-story is not to ~,e ~.onstructed, revised plans shall be submitted
to staFf for approval prior to t;;e issuan:2 of a Suilding permit.
~ 2. T;~at this variance shall he in ei'r~_.c for a period of three years to allow time for
~ its constructi.on, and that at ti;a end cf said t}~ree ~ears if any additional time is necessary,
! a time extension equal to the originai cnree years may be granted by the Planning Commission
and/or City ~ouncil.
